Comparing these marks, LEO ROSSI with SERGIO ROSSI the Hearing Officer came to the conclusion that whilst the goods were similar the marks were not similar enough as to have given rise to a likelihood of confusion at the material date. The opposition under Section 5(2) and Section 5(4) therefore failed.
