Summary
This was an appeal from the Hearing Officer’s decision of 30 July 2001 (see BL O/324/01), which had been taken on the basis of the papers filed in the proceedings. During the course of the appeal hearing the Appointed Person detected a misunderstanding existing between the parties concerning the intended use of the mark. This was cleared up and a revised specification agreed which would allow the application to proceed unopposed.
