Section 5(2)(b): Opposition Failed
Points Of Interest
Summary
The application specified “Solid fuel burning decorative fireplaces.” The opposition was based on a CTM “QUADRA” registered in respect of “Built-in ovens and hobs, gas and electric cookers, extractor hoods.” The Hearing Officer found the respective marks had “a good degree of similarity.” However, she found that the respective goods were “not in competition nor (were) they complementary.” Overall, she found no likelihood of confusion and the opposition failed accordingly.
