The Weights and Measures (Solid Fuel) Regulations 1978

The Secretary of State, in exercise of powers conferred by section 21(4) of the Weights and Measures Act 1963 (hereinafter referred to as "the Act of 1963") and now vested in him(1), and his powers under paragraph 3C(3) of Schedule 6 to the Act of 1963 as amended by Schedule 4 to the Weights and Measures &c Act 1976, (hereinafter referred to as "the Act of 1976") and of all other powers enabling him in that behalf, hereby makes the following Regulations:-

1. These Regulations may be cited as the Weights and Measures (Solid Fuel) Regulations 1978, and shall come into operation on 1st April 1978.

2. The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

3. The information required to be displayed on a vehicle by virtue of paragraph 3C(2) of Schedule 6 to the Act of 1963 as amended by Schedule 4 to the Act of 1976 shall comply with the following provisions of these Regulations.

4.-(1) The information required by paragraph 3C(2)(a) shall be in the following terms:-

"All open sacks on this vehicle contain either 25kg or 50kg".

(2) The information-

(a)shall be marked on the vehicle or on a durable material securely affixed to the vehicle:

(b)shall be clearly and permanently inscribed in characters of a height of not less than 6 cm; and

(c)shall be easily read from either side of the vehicle.

5. The statement required by paragraph 3C(2)(b) of the said Schedule 6, as so amended, to be displayed on a vehicle shall comply with the provisions of paragraph (2) of Regulation 4 above with the substitution in subparagraph (b) of that paragraph of 3 cm for 6 cm.

EXPLANATORY NOTE

These Regulations prescribe the manner in which information required to be displayed on a vehicle shall be displayed where solid fuel is carried on the highway for sale in open containers made up in metric quantities. The information relates to the indication of quantity or quantities of solid fuel comprised in the containers on, or delivered from, the vehicle. The Regulations also prescribe the form in which the required statement of the name and address of the seller shall be displayed.
