ROAD TRAFFIC

The Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1984

The Secretary of State for Transport, in exercise of the powers conferred by sections 47(1) and 50(1) of the Road Traffic Act 1972(1), now vested in him(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of the said Act, hereby makes the following Regulations:-

1. These Regulations shall come into operation on 1st October 1984 and may be cited as the Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1984.

2. The Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 are hereby amended so that in Schedule 1 (Type Approval Requirements) for items 14B and 14C there are substituted items 14B and 14C in the Schedule to these Regulations.

EXPLANATORY NOTE

1. These Regulations amend the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 by revising the type approval requirements relating to noise and silencers with the effect that:-

(a) from 1st October 1985, vehicles for which, or for a model of which, there is no type approval or Minister's approval certificate in force on that date must comply with the provisions of either Council Directive 70/157/EEC as amended by Commission Directive 73/350/EEC, Council Directive 77/212/EEC and Commission Directive 81/334/EEC or with the provisions of those Directives as most recently amended by Commission Directive 84/372/EEC;

(b) vehicles for which, or for a model of which, there is a type approval or Minister's approval certificate in force on 1st October 1985 may comply with the provisions of Council Directive 70/157/EEC as amended by Commission Directive 73/350/EEC and Council Directive 77/212/EEC, or with the provisions of those Directives as further amended by Commission Directive 81/334/EEC, or with the provisions of those Directives as most recently amended by Commission Directive 84/372/EEC; and

(c) in item 14C, in column (3)(c), in relation to Council Directive 70/157/EEC as amended by Commission Directive 81/334/EEC, a derogation is added in respect of certain vehicles having 5 or more forward gears.

2. Copies of the EEC Directives referred to in these Regulations may be obtained from Her Majesty's Stationery Office.
