Order made by the Treasury on the recommendation of the Secretary of State, laid before the House of Commons under section 5(3) and paragraph 4 of Schedule 2 to the European Communities Act 1972 for approval by resolution of the House of Commons within 28 days beginning with the day on which the Order was made, subject to extension for periods of dissolution, prorogation or adjournment for more than four days.

The Treasury, by virtue of the powers conferred on them by section 5(1) and (3) of, and paragraph 4 of Schedule 2 to, the European Communities Act 1972(1) and of all other powers enabling them in that behalf, on the recommendation of the Secretary of State, hereby make the following Order:
1. This Order may be cited as the Customs Duties (ECSC) (No. 2) (Amendment No. 9) Order 1987 and shall come into force on 15th July 1987.
2. Up to and including 31st December 1987, article 6(1) of the Customs Duties (ECSC) (No. 2) Order 1985(2) (which exempts from duty goods to which that Order applies originating in certain countries) shall not apply to goods which fall within headings 73.08, 73.11 AI, AIV a) 1 and 73.11B which originate in Yugoslavia.

This Order comes into operation on 15th July 1987. It continues in effect the provisions formerly contained in the Customs Duties (ECSC) (No. 2) (Amendment No. 6) Order 1987 and the Customs Duties (ECSC) (No. 2) (Amendment No. 7) Order 1987.
This Order reimposes duties on goods falling within headings 73.08, 73.11 AI AIV a) 1 and 73.11B which originate in Yugoslavia. Decision 86/642/ECSC of the representatives of the governments of the Member States of the European Coal and Steel Community meeting within the Council on 22nd December 1986 (OJ No. L380 of 31.12.1986, p.59) established ceilings for imports of certain ECSC products originating in Yugoslavia. These ceilings have now been reached on products falling within the above headings.
The Commission Communications to Member States giving notice of the reintroduction of customs duties were published in OJ No. C138 of 23.5.1987 and OJ No. C154 of 12.6.1987.
