The Secretary of State, in exercise of the powers conferred by section 1(1) of the Wireless Telegraphy Act 1949(1)(a) as enacted and also as extended by the Wireless Telegraphy (Channel Islands) Order 1952(2)(b) and the Wireless Telegraphy (Isle of Man) Order 1952(3)(c) and now vested in him(4)(d), and of all other powers enabling him in that behalf, hereby makes the following Regulations:–

1.  These Regulations may be cited as the Wireless Telegraphy (Exemption) (Amendment) (Cordless Telephone Apparatus) Regulations 1987 and shall come into force on 21st May 1987.

2.  In these Regulations –

3.  In regulation 2 of the principal Regulations, for the definition of "cordless telephone apparatus" there shall be substituted the following definition:–

""Cordless telephone apparatus" means apparatus for wireless telegraphy consisting of a base station and one or more mobile stations where:–

(i)each of such stations is designed or adapted to be used

(a)to send verbal messages to be conveyed over a public telecommunication system; and

(b)to receive messages conveyed over a public telecommunication system; and

(ii)each of such stations is capable of simultaneously sending such verbal messages to any and every other such station; and

(iii)the base station only is capable of connection to a public telecommunication system".

4.  In regulation 3 of the principal Regulations the words "one only" shall be deleted and replaced by the words "not more than two".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Wireless Telegraphy (Exemption) Regulations 1982 which exempt the installation and use of cordless telephones from the requirement for a licence under Section 1(1) Wireless Telegraphy Act 1949 subject to the conditions specified in the Regulations. For the purposes of exemption "cordless telephone apparatus" has been redefined to take account of the effect of technical progress in design.

The 1982 Regulations are further amended to reflect an amendment to the Performance Specification MPT 1322, first published in August 1982 as Home Office Performance Specification MPT 1322. Performance Specification MPT 1322 as amended, enables cordless telephones to operate on not more than two frequencies, rather than only one frequency as was previously the case.
