The Licensing Act 1988 (Commencement No. 2) Order 1988

28th July 1988

In exercise of the powers conferred upon me by section 20(3) of the Licensing Act 1988(1), I hereby make the following Order:

1. This Order may be cited as the Licensing Act 1988 (Commencement No. 2) Order 1988.

2. The provisions of the Licensing Act 1988 specified in the Schedules to this Order shall come into force on the dates mentioned in the headings of those Schedules.

SCHEDULE 1PROVISIONS OF THE LICENSING ACT 1988 COMING INTO FORCE ON 22ND AUGUST 1988

Provisions of the ActSubject matter of provisions
Section 1.Modification of permitted hours.
Section 3.Restriction orders.
Section 5.Discretion with respect to grant, and limitation, of special hours certificates.
Section 9.Provisional grant of new licence or removal.
Section 11.Extension of duration of justices' licences and canteen licences.
Section 13.Power of clerk to licensing justices to grant unopposed renewals of justices' licences and canteen licences.
Section 14.Modification of constitution and procedure of licensing justices.
Section 19(1) to the extent necessary to bring into force paragraphs 1, 7, 8(a), 9, 11, 12, 13, 14, 15(a) and 19 of Schedule 3.Minor amendments of the principal Act(2).
Section 19(2) so far as it relates to the repeals specified in Schedule 4 in sections 2(3)(b), 6(4), 7, 60, 62(2), 80(2), 95 and 151(5) of, and in paragraph 9 of Schedule 2 to, the principal Act, in Schedule 7 to the Finance Act 1967(3), in Schedules 6 and 12 to the Criminal Law Act 1977(4), in Schedule 7 to the Magistrates' Courts Act 1980(5) and of the Licensing (Restaurant Meals) Act 1987(6).Repeals.
Schedule 1.Amendments of the principal Act consequential on section 1.
Schedule 2.Restriction orders: procedure.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 22nd August 1988 and 1st March 1989 respectively the provisions of the Licensing Act 1988 set out in Schedules 1 and 2 to the Order. All other provisions of the Act not set out in those Schedules will come into force on 1st August 1988 (S.I. 1988/1187).
