The Secretary of State, in exercise of the powers conferred on him by sections 98 and 108(1) of the National Health Service (Scotland) Act 1978 (1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.-(1) These Regulations may be cited as the National Health Service (Charges to Overseas Visitors) (Scotland) Amendment Regulations 1988 and shall come into force on 1st February 1988.
(2) In these Regulations "the principal Regulations" means the National Health Service (Charges to Overseas Visitors) (Scotland) Regulations 1982 (2).
2.-(1) In regulation 3 of the principal Regulations (services exempted from charges) for paragraph (d) there shall be substituted the following paragraph:-
"(d)at a special clinic for the treatment of sexually transmitted diseases or in respect of a sexually transmitted disease by virtue of a reference from such a clinic, but, in the case of services which relate to infection with any Human Immunodeficiency Virus, only to the extent that they consist of a diagnostic test for evidence of infection with any such Virus and counselling associated with that test or its result; or".
(2) In Schedule 3 to the principal Regulations (charges for services provided for overseas visitors otherwise than as in-patients) (3) there shall be added at the end of columns (1) and (2) respectively the following entries:-

These Regulations amend the National Health Service (Charges to Overseas Visitors) (Scotland) Regulations 1982 which prescribe charges for some overseas visitors for services forming part of the National Health Service.
Regulation 2(1) replaces an exemption from charges relating to clinics for sexually transmitted diseases; in particular, the new exemption extends, in the case of treatment relating to a Human Immunodeficiency Virus (HIV), only to testing and associated counselling.
Regulation 2(2) introduces a charge for hospital out-patients for the supply of a drug or medicine designed to treat HIV.
1978 c. 29; section 108(1) contains a definition of "prescribed" relevant to the exercise of the statutory powers under which these Regulations are made.
