(This Note is not part of the Regulations)
These Regulations provide for the exemption from the provisions of section 1(1) of the Wireless Telegraphy Act 1949 of certain cordless telephone apparatus. Such apparatus may therefore be installed and used without a wireless telegraphy licence.
The regulations apply to cordless handportable sets and base stations which operate in the band 864.1 MHz to 868.1 MHz using digital technology.
The exemption is subject to the condition that the Department of Trade and Industry MPT Performance Specification 1334 is complied with, and that the apparatus does not cause undue interference. Copies of MPT 1334 may be obtained free of charge from the Librarian, Radiocommunications Division, Department of Trade and Industry, Waterloo Bridge House, Waterloo Road, London SE1 8UA.
The use of the exempt apparatus remains subject to the requirement of a licence under section 7 of the Telecommunications Act 1984. Details of the licensing arrangements applicable may be obtained from the Office of Telecommunications, Atlantic House, Holborn Viaduct, London EC1N 2HQ.
This exemption is additional to the existing exemption for certain other cordless telephone apparatus contained in the Wireless Telegraphy (Exemption) Regulations 1982 (S.I. 1982/1697) as amended by the Wireless Telegraphy (Exemption) (Amendment) (Cordless Telephone Apparatus) Regulations 1987 (S.I. 1987/775).
