The Secretary of State, in exercise of the powers conferred on him by section 84(7) of the Telecommunications Act 1984(1) ("the Act"), and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Wireless Telegraphy Apparatus (Approval) (Test Fees) Order 1988 and shall come into force on 12th December 1988.

Interpretation

2. In this Order,"apparatus" means wireless telegraphy apparatus or apparatus designed or adapted for use in connection with wireless telegraphy apparatus.

Application

3. This Order applies to the charging of fees in respect of the testing of apparatus to MPT Performance Specifications conducted in the exercise of the Secretary of State's functions under section 84 of the Act for the purpose of the determination of an application for approval under that section.

Test fees

4. Schedule 1 shall have effect for the purposes of setting the scale of test charges applicable to the charging of fees pursuant to this Order and the points on that scale, and"scale" and"point" shall be construed accordingly.

5. The fee to be charged in respect of the testing of each description of apparatus listed in Column 1 of Schedule 2 to any one MPT Performance Specification, or any one combination of MPT Performance Specifications, as the case may be, specified in relation to that description of apparatus in Column 2 shall be the sum of-

(a)the test charge at the point on the scale specified in relation to such testing in Column 3; and

(b)an amount equal to the amount of value added tax payable by the Secretary of State in respect of such testing.

Explanatory Note

(This note is not part of the Order)

This Order provides for the charging of fees for tests of wireless telegraphy apparatus to MPT Performance Specifications conducted on behalf of the Secretary of State for Trade and Industry for the purposes of determining applications for type approval under section 84 of the Telecommunications Act 1984.

Apparatus in respect of which type approval has been applied for may be required to comply with one or several MPT Performance Specifications. The fees provided for in this Order are payable in respect of each such test, or specified combinations of tests.

Tests on behalf of the Secretary of State for Trade and Industry are generally conducted at the Radio Technology Laboratory (Kenley), Whyteleafe Hill, Whyteleafe, Surrey CR3 0YY.

For many MPT Performance Specifications, tests acceptable for the purposes of application for type approval may be conducted by certain non-governmental laboratories. The fees in respect of such tests are not covered by this Order, but rather are set by those laboratories themselves.

MPT Performance Specifications may be obtained free of charge from the Radio Technology Laboratory, or from the Librarian, Radiocommunications Division, The Department of Trade and Industry, Waterloo Bridge House, Waterloo Road, London SE1 8UA.

Value added tax is payable by the Secretary of State on the test charges set out in this Order pursuant to a Direction of the Treasury under section 27(2) and (3) of the Value Added Tax Act 1983 (c. 55) made on 27th March 1985. The Direction came into force on 1st April 1985 and was published in the London Gazette on 17th May 1985. The relevant provision is under"Department of Trade and Industry" (paragraph 42 in Column 1 of the Direction) at item 9 in Column 2.
