The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by paragraph 26 of Schedule 26 to the Water Act 1989(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1. This Order may be cited as the Rivers (Prevention of Pollution) Act 1951 (Continuation of Byelaws) Order 1989 and shall come into force on 1st September 1989.

Continuation of byelaws

2. The byelaws specified in the Schedule to this Order, being byelaws made by virtue of section 5(1)(c) of the Rivers (Prevention of Pollution) Act 1951(2) (keeping on streams and other waters of vessels provided with sanitary appliances) shall, insofar as they are in force immediately before the transfer date, have effect on and after that date as if made by the National Rivers Authority under section 114 of the Water Act 1989 (byelaws for preventing pollution of controlled waters).

Article 2

SCHEDULEBYELAWS HAVING EFFECT AS IF MADE UNDER SECTION 114 OF THE WATER ACT 1989

1. Byelaws made by the East Suffolk and Norfolk River Authority on 10th November 1967; confirmed on 15th July 1969 and brought into operation on 1st January 1973.

2. Byelaws made by the Lancashire River Authority on 17th February 1972; confirmed on 12th November 1973 and brought into operation on 1st January 1977.

3. Byelaws made by the Severn River Authority on 14th May 1971; confirmed on 31st January 1974 and brought into operation on 1st January 1979.

Explanatory Note

(This note is not part of the Order)

Section 114 of the Water Act 1989 enables the National Rivers Authority to make byelaws for preventing pollution of controlled waters, including byelaws concerning the keeping or use on any controlled waters of vessels provided with sanitary appliances.

This Order provides that the byelaws listed in the Schedule to the Order, which were made by virtue of section 5(1)(c) of the Rivers (Prevention of Pollution) Act 1951 and relate to the keeping on streams and other waters of vessels provided with sanitary appliances, continue to have effect on and after the transfer date as if made by the National Rivers Authority under section 114 of the 1989 Act. (The transfer date is the date on which the water authorities' functions, property, rights and liabilities are divided between their successor companies and the National Rivers Authority.)

1951 c. 64; byelaws made before 1st April 1974 continue to apply on and after that date by virtue of paragraph 11 of Schedule 6 to the Water Act 1973 (c. 37).
