CHANGES IN LOCAL GOVERNMENT AREAS

The Grampian and Highland Regions and Moray and Badenoch and Strathspey Districts (Dava/Aitnoch Farm) Boundaries Amendment Order 1989

Whereas under section 17(1) of the Local Government (Scotland) Act 1973( (1)) the Local Government Boundary Commission for Scotland on 24th October 1988 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas between Grampian Region and Highland Region and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Title and commencement

1. This Order may be cited as the Grampian and Highland Regions and Moray and Badenoch and Strathspey Districts (Dava/Aitnoch Farm) Boundaries Amendment Order 1989, and shall come into force on 1st April 1989.

Interpretation

2. In this Order-

"the 1977 Regulations" means the Local Government Area Changes (Scotland) Regulations 1977( (2)); and

"boundary map" means the map prepared by the Scottish Office marked "The Grampian and Highland Regions and Moray and Badenoch and Strathspey Districts (Dava/Aitnoch Farm) Boundaries Amendment Order 1989 Map" and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a boundary of a region is a reference to a boundary existing immediately before the commencement of this Order.

Application of Regulations

3. Save insofar as they can have no application in relation to the area changes affected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.-(1) Part of Badenoch and Strathspey District in Highland Region, being the Area A described in the Schedule to this Order and shown delineated, hatched and marked "Area A" on the boundary map, shall be transferred to Moray District in Grampian Region.

(2) Part of Moray District in Grampian Region, being the Area B described in the Schedule to this Order and shown delineated, hatched and marked "Area B" on the boundary map, shall be transferred to Badenoch and Strathspey District in Highland Region.

Consequential changes of electoral arrangements

5.-(1) Area A described in the Schedule to this Order (being the Area A transferred by article 4(1) of this Order)-

(a)shall cease to form part of electoral division 43 (Strathspey) of Highland Region( (3)) and of ward 3 of Badenoch and Strathspey District( (4)); and

(b)shall form part of electoral division 3 (Ernedal) of Grampian Region( (5)) and of ward 6 (Findhorn Valley) of Moray District( (6)).

(2) Area B described in the Schedule to this Order (being the Area B transferred by article 4(2) of this Order)-

(a)shall cease to form part of electoral division 3 (Ernedal) of Grampian Region and of ward 6 (Findhorn Valley) of Moray District; and

(b)shall form part of electoral division 43 (Strathspey) of Highland Region and of ward 3 of Badenoch and Strathspey District.

SCHEDULE

Area A

The area bounded by a line commencing on the regional boundary at a point grid reference NJ 0046 3899 on the north side of the A939 road to the east of the Bridge of Dava; then generally southwards on the eastern side of the A939 road to its southernmost junction with the A940 road at a point grid reference NJ 0043 3876; then northeastwards along the southeastern side of the A940 road to rejoin the regional boundary at a point grid reference NJ 0067 3899; then generally westwards along the said regional boundary to the point of commencement.

Area B

The area bounded by a line commencing on the regional boundary at a point grid reference NH 9787 4021 on the eastern side of the A939 road; then generally southwards along the eastern side of that road to a point grid reference NH 9801 3971; then generally southeastwards and southwards by fence line to the northeastern corner of the Aitnoch Farm farmhouse at a point grid reference NH 9818 3967; then generally southwards along the eastern wall of that farmhouse and thereafter by fence line to the north side of the A939 road at a point grid reference NH 9816 3961; then generally southeastwards along the north side of that road to rejoin the regional boundary at a point grid reference NJ 0046 3899 to the east of the Bridge of Dava; then generally southwestwards, northwestwards, northwards and generally northeastwards along the said regional boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers an area of approximately 2 hectares from Badenoch and Strathspey District in Highland Region to Moray District in Grampian Region and an area extending to approximately 640 hectares from Moray District in Grampian Region to Badenoch and Strathspey District in Highland Region and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order as from 1st April 1989.

Copies of the detailed boundary map defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Development Department's Map Library, New St Andrew's House, St James Centre, Edinburgh, EH1 3SZ.

The electoral divisions of Highland Region were constituted by S.I. 1978/59

The wards of Badenoch and Strathspey District were constituted by S.I. 1979/943, to which there are amendments not relevant to this Order.
