The Secretary of State, in exercise of the powers conferred on him by sections 135(5) and (6) and 233(2) of the Local Government (Scotland) Act 1973(1) and of all other powers enabling him in that behalf, after consultation in accordance with section 135(7) of that Act(2) with all local authorities and river purification boards whose areas are wholly or partly within the areas affected by this Order, and having complied with the provisions of Schedule 7 to the Water (Scotland) Act 1980(3), hereby makes the following Order:
1. This Order may be cited as the River Purification Boards (Establishment) Variation (Scotland) Order 1989 and shall come into force on 12th January 1989.
2. In this Order, "the Establishment Orders" means the Orders specified in column (1) of Schedule 1 to this Order.
3. For article 7(1) of each of the Establishment Orders there shall be substituted-
"(1) For the purposes of section 6(1) of the Act of 1951, the Board's expenses shall be defrayed by the councils of the regions whose areas are comprised wholly or partly in the river purification board area and shall be apportioned and allocated among the said regions in the proportions stated against the names of the Board and the said regions in columns (1), (2) and (3) respectively of Schedule 2 to the River Purification Boards (Establishment) Variation (Scotland) Order 1989.".
4. Schedule 2 to this Order shall have effect for the purposes of article 7(1) of each of the Establishment Orders, as substituted by article 3 of this Order.

(This note is not part of the Order)
River purification boards' annual expenses are at present apportioned among the regional councils concerned on the basis of the "penny rate product". This basis will no longer be available on the abolition of domestic rates as from 1st April 1989. The Order substitutes in the river purification boards' Establishment Orders fixed proportions as a basis for apportionment. Where river purification boards' areas include only a small part of a regional council's area, the apportionment against that council is nil.
Section 135(7) was amended by the Water (Scotland) Act 1980 (c. 45), Schedule 9, paragraph 3.
