The Vehicles (Charges for Release from Immobilisation Devices) Regulations 1989

In exercise of the powers conferred upon me by sections 104(4) and 142(1) of the Road Traffic Regulation Act 1984(1), I hereby make the following Regulations:

1.-(1) These Regulations may be cited as the Vehicles (Charges for Release from Immobilisation Devices) Regulations 1989 and shall come into force on 1st June 1989.

(2) The Vehicles (Charges for Release from Immobilisation Devices) Regulations 1985(2) are hereby revoked.

2. For the purposes of section 104(4) of the Road Traffic Regulation Act 1984, the charge in respect of the release of a vehicle from an immobilisation device shall be £30.

Explanatory Note

(This note is not part of the Regulations)

Section 104 of the Road Traffic Regulation Act 1984 empowers a constable to fix an immobilisation device to an illegally parked vehicle and provides for a charge to be prescribed for the release of a vehicle from a device which has been affixed to it in accordance with the section. By virtue of the Vehicles (Charges for Release from Immobilisation Devices) Regulations (S.I. 1985/1660) the prescribed charge is £25. These Regulations revoke the 1985 Regulations and prescribe a new charge of £30.
