The Lord Chancellor, in exercise of the power conferred on him by section 3(4) of the Legal Aid Act 1988(1), hereby makes the following Order, a draft of which has, in accordance with section 36(2)(b) of that Act, been laid before and approved by resolution of each House of Parliament.
1. This Order may be cited as the Legal Aid (Functions) (No. 2) Order 1989 and shall come into force on the day on which it is made.
2. The general function conferred on the Legal Aid Board by section 3(2) of the Legal Aid Act 1988 shall include determination of the costs of representation for the purposes of the proceedings mentioned in subsection (4)(c) of that section, and all matters relating to such determination.

This Order confers on the Legal Aid Board the function of determining the costs of representation in care proceedings in juvenile courts and the Crown Court.
