The Secretary of State, in exercise of the powers conferred by section 7 of the Trade Union (Amalgamations, etc.) Act 1964(1) and now vested in him by the Secretary of State for Employment and Productivity Order 1968(2), and section 8(2) of the Employment Protection Act 1975(3) and of all other powers enabling him in that behalf, and as respects regulation 2 with the approval of the Treasury, hereby makes the following Regulations:

Citation, commencement and revocation

1.-(1) These Regulations may be cited as the Certification Officer (Amendment of Fees) Regulations 1990 and shall come into force on 1st April 1990.

(2) Regulation 3 of the Certification Officer (Amendment of Fees) Regulations 1989(4) is hereby revoked.

Amendment of fees payable to the Certification Officer

2. In paragraph (1) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975(5) (fee to accompany an application for approval of a proposed instrument of amalgamation or transfer) for the words "£200" there shall be substituted the words "£290".

3. The fee of £275 is hereby prescribed for the purposes of section 8(2) of the Employment Protection Act 1975 (fee on application by a trade union for a certificate of independence).

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 1st April 1990, increase the fee payable to the Certification Officer on an application for approval of a proposed instrument of amalgamation or transfer from £200 to £290 and the fee payable to him on an application by a trade union for a certificate of independence from £225 to £275.

Other fees payable to the Certification Officer but not increased by these Regulations are as follows-

(a)£40 on an application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations maintained by the Certification Officer (S.I. 1988/310);

(b)£12.50 for the entry of the name of an amalgamated organisation in those lists where the name of each of the amalgamating organisations is already so entered (S.I. 1981/1631);

(c)£14 for the approval by the Certification Officer of a change of name by a trade union or employers' association (S.I. 1988/310); and

(d)£3 for an inspection of documents kept by the Certification Officer under the Trade Union (Amalgamations, etc.) Act 1964 (S.I. 1988/310).
