The Natural Heritage (Scotland) Act 1991 (Commencement No. 1) Order 1991

The Secretary of State, in exercise of the powers conferred upon him by section 28(2) of the Natural Heritage (Scotland) Act 1991(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1. This Order may be cited as the Natural Heritage (Scotland) Act 1991 (Commencement No. 1) Order 1991.

2. In this Order "the Act" means the Natural Heritage (Scotland) Act 1991.

3. The provisions of the Act which are specified in column 1 of the Schedule to this Order shall come into force on 1st October 1991, but where a particular purpose is specified in relation to any such provision in column 2 of that Schedule, that provision shall come into force on that day only for that purpose.

Explanatory Note

(This note is not part of the Order)

This Order provides for Part II of the Natural Heritage (Scotland) Act 1991 (which deals with the control of abstraction of water for irrigation purposes) and Part III of that Act (which deals with the control of water use in times of drought) to come into force on 1st October 1991, together with the relevant Schedules 5 to 9. The Order also provides for commencement on that date of those provisions of Part IV (General) of the Act which are relevant to Parts II and III and those amendments in Schedule 10 and repeals in Schedule 11 which relate to water or sewerage legislation. In particular, among the amendments which are commenced are provision increasing the penalties for certain offences under the Sewerage (Scotland) Act 1968 (c. 47) and provision for altering the composition of river purification boards.
