The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 84(1) of the Animal Health Act 1981(1), and of all other powers enabling them in that behalf, with the approval of the Treasury, hereby make the following Order:

Title and commencement

1. This Order may be cited as the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) (Amendment) Order 1991 and shall come into force on 1st April 1991.

Amendment

2. For the Schedule to the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1990(2) (which specifies fees to be paid in respect of specified transactions) there shall be substituted the Schedule set out in the Schedule to this Order.

PART II-PAYMENT TO THE MINISTER

1. Taking or the supervision of taking (as the case may be) by an officer of the Minister of samples from breeding flocks under article 6(a) of, and paragraphs 2(f) and 3 of Part I of Schedule 3 to, and article 7(a) of, and paragraph 1 of Part I of Schedule 4 to, the Breeding Flocks Order.

£20 per ½ hour (or part thereof) of each visit.

2. Supervision by an officer of the Minister of the taking of samples from hatcheries under article 8(a) of, and paragraphs 1 and 2 of Part II of Schedule 3 to, the Breeding Flocks Order.

£20 per ½ hour (or part thereof) of each visit.

3. Examination of samples from breeding flocks by an officer of the Minister, under article 6(a) of, and paragraphs 2(f) and 3 of Part I of Schedule 3 to, the Breeding Flocks Order, of-

(a)a composite faeces sample

(b)cloacal swabs (up to a maximum of 30)

£7.50

(c)a composite dust sample.

4. Examination of samples from hatcheries by an officer of the Minister, under article 8(a) of, and paragraph 1(a)-�(c) of Part II of Schedule 3 to, the Breeding Flocks Order, of-

(a)a composite meconium sample

5.-(a) Inspection prior to the authorisation of a laboratory for the purposes of the Laying Flocks Order, the Breeding Flocks Order or the Processed Animal Protein Order 1989(3);

(b)distribution of quality assurance samples prior to the authorisation of a laboratory for the purposes of these Orders;

(c)issue of an annual authorisation for the purposes of these Orders.

6. Inspection of a laboratory with a view to deciding whether the annual authorisation should be renewed or revoked.

Explanatory Note

(This note is not part of the Order)

This Order amends the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1990 by substituting a new Schedule for the Schedule to that Order (article 2). The new Schedule sets out increased fees from those specified in the Schedule for some of the transactions specified in it in respect of laying and breeding flock and hatchery premises and for the purposes of certain Orders relating to poultry and protein processing.
