The Secretary of State for Wales, in exercise of the powers conferred on him by sections 42(1), (3) and (6) and 63(5) of the Local Government (Wales) Act 1994(1) and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Local Government Reorganisation (Wales) (Staff) (No. 2) Order 1996 and shall come into force on 1st April 1996.

Interpretation

2.-(1) In this Order-

"the 1994 Act" means the Local Government (Wales) Act 1994;

"new authority" means a county or county borough council which is established under the 1994 Act or a National Park authority established by article 3 of the National Park Authorities (Wales) Order 1995(2);

"old authority" means a county or district council which ceases to exist as a result of the 1994 Act;

"the deposited list" has the same meaning as in the principal order; and

"the principal order" means the Local Government Reorganisation (Wales) (Staff) Order 1996(3).

(2) For the purposes of articles 4 and 5, a person is described in column 2 of the Schedule by reference to one or more of the following-

(a)his name,

(b)his employee number which is within brackets unless the context otherwise requires,

(c)the title or description of his post,

(d)the establishment at which or the geographical area within which he works.

Application

3. This order shall not apply to any person who is an employee of an old authority-

(a)whose contract of employment provides for the termination of that contract on 31st March 1996;

(b)who is dismissed with effect from 31st March 1996 (unless that person is later reinstated with effect from that date);

(c)who terminates his contract of employment as at 31st March 1996.

Amendment of the principal order

4.-(1) Article 5 of the principal order shall not apply to any person described in column 2 of Part I or Part II of the Schedule to this Order who, immediately before 1st April 1996, was employed by the old authority specified in relation to that person in column 1 of Part I or Part II of the Schedule, as the case may be.

(2) In the Schedule to the principal order, in the list of numbered Parts of the desposited list to which reference is made in the section headed Category 2, under Part 7 (Gwynedd County Council), in column 1 there shall be deleted "(e)", and in column 2 in the corresponding entry there shall be deleted"Anglesey County Council and Caernarfonshire and Merionethshire County Council".

Designation of staff

5.-(1) Subject to article 3, any person who, immediately before 1st April 1996, was employed by an old authority named in column 1 of Part II or Part III of the Schedule to this Order and who is described in column 2 of Part II or Part III of the Schedule, as the case may be, is hereby designated for the purposes of section 42 of the 1994 Act.

(2) In relation to any person designated under paragraph (1), the new authority named in column 3 of Part II or Part III of the Schedule, as the case may be, in relation to the person so designated shall be the specified new employer of that person for the purposes of section 42 of the 1994 Act.

Explanatory Note

(This note is not part of the Order)

This Order supplements and amends the Local Government Reorganisation (Wales) (Staff) Order 1996 ("the principal order") which makes provision for the designation of employees of district and county councils which are abolished by virtue of the Local Government (Wales) Act 1994 and specifies new employers for employees so designated.

Article 4 of the order disapplies the principal order in relation to employees described in Parts I and II of the Schedule and effects a minor amendment to the Schedule to the principal order.

Article 5 of the order designates employees described in Parts II and III of the Schedule and specifies new employers for such employees.

S.I. 1995/2803; article 16 has the effect that references to new principal councils which may be specified as a new employer for the purposes of section 42(2) of the 1994 Act include reference to a National Park authority in Wales.
