The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the return of cultural objects unlawfully removed from the territory of a member State, in exercise of the powers conferred on him by section 2(2) of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
1.-(1) These Regulations may be cited as the Return of Cultural Objects (Amendment) Regulations 1997 and shall come into force on 1st September 1997.
(2) These Regulations extend to Northern Ireland.
2.-(1) The Return of Cultural Objects Regulations 1994(3) shall be amended in accordance with the provisions of this regulation.
(2) In regulation 2(1) (interpretation) at the end there shall be inserted "as amended by the Council Directive No. 96/100/EC"(4).
(3) In the Schedule to the Regulations after the entry in respect of 10 (printed maps) there shall be inserted-
"£23,800.00
3A. (Water colours, gouaches and pastels)".

These Regulations implement Directive 96/100/EC of the European Parliament and of the Council (OJ No. L60, 17.2.97, p.59) which amends the Annex to Directive 93/7/EEC on the return of cultural objects unlawfully removed from the territory of a member State (OJ No. L74, 27.3.93, p.74), which in turn was implemented by the Return of Cultural Objects Regulations 1994 (S.I. 1994/501) ("the 1994 Regulations").
Regulation 2(2) amends the definition of "the Directive" in the 1994 Regulations so that it includes a reference to Directive 96/100/EC.
Regulation 2(3) introduces an additional category of objects which may constitute a national treasure for the purposes of the 1994 Regulations provided the monetary value of any such object is above the specified financial threshold.
