The Secretary of State for Transport, in exercise of the powers conferred by sections 125(3), 125A(5), 127(2), 129(1) and (2), 132(2) and 141 of the Road Traffic Act 1988(1), hereby makes the following Regulations:-

1. These regulations may be cited as the Motor Cars (Driving Instruction) (Amendment) Regulations 1997 and shall come into force on 1st April 1997.

2. The Motor Cars (Driving Instruction) Regulations 1989(2) shall be amended in accordance with the following provisions.

3. After regulation 9 there shall be inserted-

"Licences granted to disabled driving instructors

9A. There is prescribed for the purposes of section 129(1)(b) of the Act the part of the examination that consists of the instructional ability and fitness test.".

4. In regulation 13, for the Table at the end, there shall be substituted the following Table-

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Cars (Driving Instruction) Regulations 1989.

In consequence of the entry into force of the Road Traffic (Driving Instruction by Disabled Persons) Act 1993, trainee instructors' licences may be granted to persons with a disability who have already passed some parts of the qualifying examination in order that they may prepare for the remaining, prescribed, parts of that examination. The Regulations prescribe the test of instructional fitness and ability for that purpose.

Secondly, the fees payable in respect of the qualifying examination and the entry of a name on the Register of Approved Driving Instructors are increased from 1st April 1997. The new fees, with the percentage increases and the dates when they were last raised shown in brackets, are:-

Retention of a name in the register£200 (5.26%, May 1995)
Trainee instructor's licence£100 (17.62%, January 1985)

1988 c. 52. Section 125A was inserted by section 1 of the Road Traffic (Driving Instruction by Disabled Persons) Act 1993 (c. 31), section 127(2) was amended by Schedule 1, paragraph 5, of that Act and subsections (1)(b) and (2) of section 129 were substituted respectively by subsections (1) and (2) of section 2 of that Act. Powers to prescribe fees are to be read with the Department of Transport (Fees) Order 1988 (S.I. 1988/643), the relevant amending instruments being S.I. 1991/811, 1993/1601 and 1995/1684.
