The A34 Trunk Road (Churchbridge) (Detrunking) Order 1998

12th February 1998

The Secretary of State for the Environment, Transport and the Regions makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in him(2), and of all other powers enabling him in that behalf:-

1. This Order may be cited as the A34 Trunk Road (Churchbridge) (Detrunking) Order 1998 and shall come into force on 12th February 1998.

2. In this Order-

(i)"classified road"

as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads:

(ii)"the new trunk road"

means the new highway which the Secretary of State proposes to construct referred to in article 2 to the A34 Trunk Road (Churchbridge) Order 1998(3);

(iii)"principal road"

as a classification for a highway means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

(iv)"the trunk road"

means the Winchester to Preston Trunk Road (A34).

3. The length of trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as an unclassified road as from the date on which the Secretary of State notifies the Staffordshire County Council that the new trunk road is open for traffic.

THE SCHEDULELength of the Trunk Road Ceasing to be a Trunk Road

The length of the trunk road ceasing to be a trunk road is from a point about 25 metres south-east from the centre of its eastern junction with the A5 Trunk Road south-eastwards for a distance of 95 metres and is shown by broad black dashes on the plan numbered HA 10/PS/197 marked "The A34 Trunk Road (Churchbridge) (Detrunking) Order 1998" signed by authority of the Secretary of State for the Environment, Transport and the Regions and deposited at the Highways Agency, Project Services, Room 12/27, St. Christopher House, Southwark Street, London SE1 0TE.
