The Secretary of State in exercise of the powers conferred on him by section 50(5) of the Fair Trading Act 1973(1), hereby makes the following Order:
1. This Order may be cited as the Monopoly References (Deletion of Exclusions) Order 1998 and shall come into force on 16th October 1998.
2. In Part II of Schedule 7 to the Fair Trading Act 1973 (goods and services partly excluded from section 50), the entries in-�
(a)paragraph 9(2) (liquid cows' milk), and
(b)paragraph 12 (potatoes),
are deleted.
3. The Monopoly References (Alteration of Exclusions) Order 1994 is revoked.

The Director General of Fair Trading ("DGFT") is excluded by section 50(3) of the Fair Trading Act 1973 ("FTA") from making monopoly references in respect of specified forms of supply of goods listed in Part II of Schedule 7 of the FTA. These include specified forms of supply of liquid cows' milk and potatoes to which no process of manufacture (other than dressing or dyeing) has been applied. This Order deletes these exclusions. The forms of supply of milk and potatoes covered by these exclusions were the subject of statutory marketing schemes. All the relevant schemes have now been revoked.
Paragraph 9 was substituted by the Monopoly References (Alteration of Exclusions) Order 1994 (S.I. 1994/1922).
