Whereas following the referral to it of a proposal by the Secretary of State in accordance with subsection (2) of section 368 of the Education Act 1996(1), Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru or the Qualifications, Curriculum and Assessment Authority for Wales ("the Authority")(2) has, in accordance with subsection (3) of that section, given notice thereof to the bodies and persons referred to in that subsection and afforded them a reasonable opportunity of submitting evidence and representations as to the issues arising;
And whereas in accordance with directions given by the Secretary of State under the said subsection (2), the Authority has submitted its report to the Secretary of State in accordance with subsection (4) of the said section 368;
And whereas the Authority has, after submitting its report to the Secretary of State, arranged for it to be published in accordance with subsection (5) of that section;
And whereas the Secretary of State has published a draft of the Order and sent copies of it to the Authority and all those who were consulted by the Authority, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsection (7) of that section;
And whereas that period has now expired:
Now therefore the Secretary of State for Wales, in exercise of the powers conferred on the Secretary of State by sections 356(2)(a) and (b) and (4) and 568(5) and (6) of the Education Act 1996 hereby makes the following Order in the terms of the said draft:
1.-(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) (Amendment) Order 1998 and shall come into force on 20th November 1998.
(2) In this Order "the principal Order" means the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) Order 1995(3).
2. The words "Subject to paragraph (2)" in article 5(1) of the principal Order, article 5(2) of the principal Order and Schedule 5 to that Order (which specifies ten non-Welsh-speaking schools to which article 5(1) of the principal Order does not apply) are omitted.

The Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) Order 1995 gives effect to the Document published in January 1995 by Her Majesty's Stationery Office entitled "Welsh in the National Curriculum" (ISBN 0117018155). So far as the requirements relating to the fourth key stage are concerned, the Order comes into force, in the case of pupils at schools which are not Welsh-speaking schools, on 1st August 1999 in respect of pupils in the first year of that key stage, and on 1st August 2000 in respect of all other pupils in that key stage-see article 5(1). However, article 5(1) does not apply in relation to pupils in the fourth key stage at the ten schools listed in Schedule 5 (all of which are non-Welsh-speaking schools)-see article 5(2).
The present Order provides that article 5(2) and Schedule 5 shall be omitted. Accordingly, the 1995 Order will come into force in relation to pupils in the fourth key stage at those ten schools on the same dates as it comes into force in relation to pupils in the fourth key stage at other non-Welsh-speaking schools in accordance with article 5(1).

Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru or the Qualifications, Curriculum and Assessment Authority for Wales was established by section 14(1)(b) of the Education Reform Act 1988 (c. 40) under the name of the Curriculum Council for Wales, renamed as the Curriculum and Assessment Authority for Wales by section 253(1) of the Education Act 1993 (c. 35), continued in existence under that name by section 360 of the Education Act 1996 and given its current name by section 27(1) of the Education Act 1997.
