Her Majesty, in exercise of the powers conferred upon Her by section 88(5) of the Scotland Act 1998(1), and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-�
1.-(1) This Order may be cited as the Scotland Act 1998 (Cross-Border Public Authorities) (Specification) Order 1999.
(2) This Order shall come into force on the principal appointed day(2).
2. The bodies, government departments, offices and office-holders mentioned in column 1 of the Schedule to this Order (and which are constituted by the enactment or, as the case may be, instrument, if any, mentioned in the corresponding entry in column 2 of that Schedule) are hereby specified for the purposes of section 88(5) of the Scotland Act 1998.

This Order specifies certain bodies, government departments, offices and office-holders as cross-border public authorities for the purposes of the Scotland Act 1998. The specified bodies, government departments, offices and office-holders are listed in the Schedule to the Order. Sections 88 to 90 of the 1998 Act make special provision for the treatment of cross-border public authorities in consequence of the provisions in that Act which confer powers on the Scottish Parliament and Scottish Executive.
Article 3 of the Scotland Act 1998 (Commencement) Order 1998 (S.I. 1998/3178) specifies 1st July 1999 as the principal appointed day for the purposes of the Scotland Act 1998.

Made by the Secretary of State on 12th December 1995 under section 1 of the Criminal Injuries Compensation Act 1995 (c. 53).
The 1990 Scheme came into operation on 1st February 1990 and is a revision of the 1964 Scheme which was announced in both Houses of Parliament on 24th June 1964 in the exercise of the prerogative power.
Section 4AA was inserted by the Sea Fish (Conservation) Act 1992 (c. 60), section 2.
Section 1(2) was amended by the National Lottery etc. Act 1993 (c. 39), Schedule 4, paragraph 1. See S.I. 1981/207 and 1986/600 for transfer of relevant Ministerial functions.
