The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 34(1) and (4) of the Channel Tunnel Rail Link Act 1996(1), and of all other powers enabling him in this behalf, hereby makes the following Order:
1. This Order may be cited as the Channel Tunnel Rail Link (Nomination) (London Underground Works) Order 1999, and shall come into force on 1st August 1999.
2. In this Order-�
"the Act" means the Channel Tunnel Rail Link Act 1996;
"the London Underground works" means-�
Work No. 4A, so far as not falling within the shared work,
Works Nos. 4AA, 4C, 4D, 4E, 4F, 4G, 4H, 4J, 4K, 4MM, 4N, 4P, 4Q, 4R, 4S and 5R, and
Work No. 4L, so far as not falling within the area indicated in blue on the drawing marked "The Channel Tunnel Rail Link (Nomination) (London Underground Works) (Nomination) Order 1999", signed by authority of the Secretary of State for the Environment, Transport and the Regions, dated 8th July 1999 and deposited in the Information Centre, Department of the Environment, Transport and the Regions, Great Minster House, 76 Marsham Street, London SW1P 4DR;
"the shared work" means such part of Work No. 4A as comprises a passenger subway commencing on the eastern side of the intended St Pancras Station beneath a point 22 metres north of the existing junction of Clarence Passage with Pancras Road and passing south-eastwards to the ticket hall beneath the northern side of the forecourt of the Great Northern Hotel, but not including the ticket hall or any part of the passenger subway that extends beyond the ticket hall and terminates by a junction with the passenger subways (Works Nos. 4AA and 4F) beneath a point 26 metres north of the north-eastern corner of the Great Northern Hotel.
3.-(1) London Underground Limited shall be the nominated undertaker for-�
(a)all purposes of section 1 of the Act in relation to the London Underground works and the shared work; and
(b)the purposes of any other provision of Part I of the Act except section 14, so far as connected with or in any way relating to those works.
(2) Union Railways (North) Limited shall be the nominated undertaker for-�
(a)all purposes of section 1 of the Act in relation to the shared work; and
(b)the purposes of any other provision of Part I of the Act except section 14, so far as connected with or in any way relating to that work.
(3) Paragraphs (1) and (2) have effect in relation to the shared work so that each of London Underground Limited and Union Railways (North) Limited acts as nominated undertaker on its own account, so that no act by one shall render the other liable in respect of it.
4. Union Railways (North) Limited shall cease to be the nominated undertaker for any purposes of the Act in relation to works comprised within Works Nos. 4J, 4K and 5R.

(This note is not part of the Order)
This Order specifies London Underground Limited and Union Railways (North) Limited as the nominated undertakers for the purposes of certain of the provisions of Part I of the Channel Tunnel Rail Link Act 1996 in relation to works at St Pancras station in London. The Order also provides that Union Railways (North) Limited shall cease to be nominated undertaker for certain works for which it was made nominated undertaker by the Channel Tunnel Rail Link (Nomination) Order 1999 (S.I. 1999/391).
