The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2] and of all other powers enabling him in that behalf: -
1.
This Order shall come into force on 1st July 2002 and may be cited as the A46 Trunk Road (Ashchurch Station Bridge) (Detrunking) Order 2002.
2.
In this Order: -
(1) all measurements of distance are measured along the route of the relevant highway;
(2)
(i) "classified road" as a classification for a highway, means that a highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State which does not specifically refer to their classification as principal roads;
(ii) "the trunk road" means the A46 Trunk Road; and
(iii) "the new trunk road" means the new highway which the Secretary of State proposes to construct referred to in article 2 of the A46 Trunk Road (Ashchurch Station Bridge) Order 2002.
3.
The length of trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies Gloucestershire County Council that the new trunk road is open for traffic.

LENGTH OF TRUNK ROAD CEASING TO BE TRUNK ROAD
The length of trunk road ceasing to be trunk road is that length of the A46 Trunk Road from a point 38 metres east of its junction with Fiddington Lane eastwards for a distance of approximately 333 metres. That length shown by broad black dashes on the plan numbered HA 10/OD 222 marked "The A46 Trunk Road (Ashchurch Station Bridge) (Detrunking) Order 2002", signed by authority of the Secretary of State for Transport, and deposited at the DTLR Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex. TN37 7GA.
