The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting in exercise of the powers conferred on him by that section, makes the following Regulations:
Title and commencement
1.
These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (England) (Amendment) (No. 3) Regulations 2002 and shall come into force on 23rd October 2002.
Amendment to the Products of Animal Origin (Third Country Imports) (England) Regulations 2002

- (1) Schedule 2 to the Products of Animal Origin (Third Country Imports) (England) Regulations 2002[3] (import conditions) is amended in accordance with paragraphs (2) and (3).
(2) The following heading is substituted for the heading to Part V (fresh poultry meat) -
"FRESH POULTRYMEAT, POULTRYMEAT PRODUCTS AND POULTRYMEAT PREPARATIONS".
(3) The following section is inserted immediately after section D (health certification requirements) of Part V -

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend Part V of Schedule 2 to the Products of Animal Origin (Third Country Imports) (England) Regulations 2002 (S.I. 2002/1227, as already amended) in order to give effect in England to Commission Decision 2002/794/EC concerning certain protective measures with regard to poultrymeat, poultrymeat products and poultrymeat preparations intended for human consumption and imported from Brazil (OJ No. L276, 12.10.2002, p. 66).

These Regulations also correct an earlier defect in S.I. 2002/1227 by including in Part V of Schedule 2 to that instrument a reference to Commission Decision 2002/251/EC concerning certain protective measures with regard to poultrymeat and certain fishery and aquaculture products intended for human consumption and imported from Thailand (OJ No. L84, 28.3.2002, p. 77). That Decision is already listed in section H of Part IX of Schedule 2 (protective measures - fishery products).

The Products of Animal Origin (Third Country Imports) (England) Regulations 2002 implement for England Council Directive 97/78/EC laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (OJ No. L24, 30.1.98, p. 9).

The products to which S.I. 2002/1227 applies are defined in regulation 2(1) of and Schedule 3 to that instrument.
5.
Schedule 2 to S.I. 2002/1227 lays down the conditions, by reference to the Community legislation listed in it, for the import of those products into England from third countries.
6.
No regulatory impact assessment has been prepared in relation to these Regulations.
