In exercise of the powers conferred upon the Secretary of State by sections 28 (1) and (2) and 138(7) of the School Standards and Framework Act 1998[1] the Secretary of State for Education and Skills makes the following Regulations:
Citation and commencement

These Regulations may be cited as The Education (School Organisation Proposals) (Amendment) (No 2) (England) Regulations 2005 and shall come into force on 1st January 2006.
Amendment of the Education (School Organisation Proposals) (England) Regulations 1999
2.
The Education (School Organisation Proposals) (England) Regulations 1999[2] shall be further amended as follows.

In regulation 2 (Interpretation) in the definition of "excepted expansion", after "paragraphs 1, 2,", insert—
"

(but in respect of a prescribed alteration falling within paragraph 3, only where the alteration of the upper age limit is being made so as to provide sixth form education)"
and for "or 12" substitute ", 12 or 13".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Education (School Organisation Proposals) (England) Regulations 1999 (No 2213).
These amendments supplement the amendments made to S.I 1999/2213 by the Education (School Organisation Proposals) (England) (Amendment) Regulations 2000 (S.I. 2000/2198), the Education (School Organisation Proposals) (England) (Amendment) Regulations 2003 (S.I. 2003/1229) and the Education (School Organisation Proposals) (England) (Amendment) Regulations 2005 (S.I. 2005/1801).
Regulation 3 adds to the definition of an "excepted expansion" so that it now includes the addition of a sixth form.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
