EXPLANATORY NOTE

(This note is not part of the Order)

The School Governance (Procedures) (England) Regulations 2003, as amended ("the Regulations"), provide that every question to be decided at a meeting of the governing body must be determined by a majority of the votes of the governors present and voting on the question (regulation 12(2) of the Regulations). This Order enables the governing body of the Monkseaton Community High School to hold meetings otherwise than in accordance with regulation 12(2) by relaxing the requirement for all governors to be physically present at such meetings.

The Order is made under section 2 of the Education Act 2002. Article 2 relaxes the requirement for all governors to be physically present in order for the governing body to make their decisions by modifying regulation 12(2) to that effect. Article 3 provides that the Order has effect until 11th May 2009.
