The Electoral Commission[1], in exercise of the powers conferred by sections 17[2] and 26[3] of the Local Government Act 1992, make the following Order:
Citation and commencement
1.
—(1) This Order may be cited as the Borough of Tunbridge Wells (Electoral Changes) (Amendment) Order 2006.
(2) This Order comes into force—
(a) for the purpose of proceedings preliminary or relating to the elections of parish councillors for the parish of Southborough, to be held on the ordinary day of election of councillors in 2007, on 15th October 2006;
(b) for all other purposes, on the ordinary day of election of councillors in 2007.
Amendment to the 2001 Order
2.
—(1) The Borough of Tunbridge Wells (Electoral Changes) Order 2001[4] shall be amended as follows:
(2) In article 6(2) and 6(3) the words "Southborough East and High Brooms" shall be substituted for the words "Southborough and High Brooms".
(3) In article 6(3) the word "six" shall be substituted for the word "five" and the word "five" shall be substituted for the word "six".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Borough of Tunbridge Wells (Electoral Changes) Order 2001, in order to give full effect to the Secretary of State's decision on recommendations by the Local Government Commission for England for electoral changes in the borough of Tunbridge Wells.
That Order was made by the Secretary of State. The functions of the Secretary of State under sections 13 to 15 and 17 of the Local Government Act 1992, so far as they relate to electoral changes, were transferred with modifications to the Electoral Commission by the Local Government Commission for England (Transfer of Functions) Order 2001 (S.I. 2001/3962) with effect from 1st April 2002.

The Electoral Commission was established by the Political Parties, Elections and Referendums Act 2000 (c.41). The functions of the Secretary of State, under sections 13 to 15 and 17 of the Local Government Act 1992 (c.19), to the extent that they relate to electoral changes within the meaning of that Act, were transferred with modifications to the Electoral Commission by the Local Government Commission for England (Transfer of Functions) Order 2001 (S.I. 2001/3962).back
