The Public Service Vehicles (Registration of Local Services) (Amendment) (England and Wales) Regulations 2009

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 52(1)(a) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981(1) and by sections 126(1) and 134 of the Transport Act 1985(2); and by virtue of The Department for Transport (Fees) Order 2009(3).

Representative organisations have been consulted in accordance with section 61(2) of the Public Passenger Vehicles Act 1981(4).

Citation, commencement and extent

1.–(1) These Regulations may be cited as the Public Service Vehicles (Registration of Local Services) (Amendment) (England and Wales) Regulations 2009 and shall come into force on 3rd May 2009.

(2) These Regulations extend to England and Wales(5).

Amendment of the principal Regulations

2. The Public Service Vehicles (Registration of Local Services) Regulations 1986(6) are amended as follows–

(a) in regulations 12(1)(a) and 12(2)(a), for "£12" substitute "£13"; and

(b) in regulations 12(1)(b) and 12(2)(b), for "£57" substitute "£60".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations increase the fees for the registration of, or the variation of the registration of, a local bus service.

The fees for a community bus service are increased from £12 to £13. This represents an increase of 8.3%. The fees for community bus services were last increased on 1st April 2007.

The fees for a local bus service other than a community bus service are increased from £57 to £60. This represents an increase of 5.3%. These fees were last increased on 1st August 2008.

Relevant amendments to sections 52(1)(a) and 60(1) of the 1981 Act were made by the Transport Act 1985 (c.67) (in these footnotes called "the 1985 Act") and by the Deregulation and Contracting Out Act 1994 (c.40) (in these footnotes called "the 1994 Act"), as follows. Section 52(1)(a) of the 1981 Act was amended by paragraphs 4(1) and 4(14) of Part II of Schedule 2 of the 1985 Act; section 60(1) of the 1981 Act was amended by paragraphs 4(1) and 4(18) of Part II of Schedule 2 of the 1985 Act and words were omitted from section 60(1) of the 1981 Act by Schedule 8 of the 1985 Act. Section 52(1)(a) of the 1981 Act was further amended by section 66(2) of the 1994 Act and section 60(1) (e) of the 1981 Act was substituted by section 66(5) of the Act. Section 60(1A) of the 1981 Act was inserted by section 134(2) (b) of the 1985 Act.
