The Secretary of State, in exercise of the powers conferred by section 1(1) of the Football (Offences) Act 1991(1), makes the following Order.
1.-(1) This Order may be cited as the Football (Offences) (Designation of Football Matches) (Amendment) Order 2011 and shall come into force on 26th May 2011.
(2) This Order extends to England and Wales.
2.-(1) The Football (Offences) (Designation of Football Matches) Order 2004(2) is amended as follows.
(2) In article 3(1) for "paragraph (2)" substitute "paragraphs (2) or (3)".
(3) In article 3(2) for "or the League of Wales," substitute ", the Scottish Football League or the Welsh Premier League, or whose home ground is for the time being situated outside England and Wales,".
(4) After article 3(2) insert-
"(3) A designated match is an association football match in competition for the Football Association Cup (other than in a preliminary or qualifying round)."

This Order, which comes into force on 26th May 2011, amends the Football (Offences) (Designation of Football Matches) Order 2004 ("the 2004 Order") which designates football matches for the purposes of the Football (Offences) Act 1991 ("the 1991 Act"). The 1991 Act introduced penalties for certain types of misconduct at designated football matches.
This Order means that matches played in the Scottish Premier League and matches involving one or both teams whose home grounds are not in England and Wales will be within the scope of the 1991 Act.
The Order also updates the reference in the 2004 Order to the Welsh Premier League.
Finally this Order also brings matches for the Football Association Cup (unless those matches are in a preliminary or qualifying round) within the scope of the 1991 Act.
