This Order is made in exercise of powers conferred by section 89(3) of the Traffic Management Act 2004 ("the 2004 Act")(1) and by paragraph 8(1) of Schedule 8, and paragraph 3(1) of Schedule 10, to the 2004 Act.
The County Council of Durham(2) has applied to the Secretary of State for an order to be made, in exercise of those powers, in respect of parts of that council's area.
The East Riding of Yorkshire Council(3) has applied to the Secretary of State for an order to be made, in exercise of those powers, in respect of part of that council's area.
The Kent County Council has applied to the Secretary of State for an order to be made, in exercise of those powers, in respect of part of that council's area.
The Norfolk County Council has applied to the Secretary of State for an order to be made, in exercise of those powers, in respect of part of that council's area.
The Warwickshire County Council has applied to the Secretary of State for an order to be made, in exercise of those powers, in respect of part of that council's area.
In accordance with the requirements of paragraph 8(3) of Schedule 8, and paragraph 3(4) of Schedule 10, to the 2004 Act, the Secretary of State has consulted the Chief Constable of Durham Constabulary, the Chief Constable of Humberside Police, the Chief Constable of Kent Police, the Chief Constable of Norfolk Constabulary and the Chief Constable of Warwickshire Police.
Accordingly, the Secretary of State(4) makes this Order.
1. This Order may be cited as the Civil Enforcement of Parking Contraventions Designation Order 2011 and comes into force on 7th November 2011.
2. The Road Traffic (Permitted Parking Area and Special Parking Area) (County of Kent) (Borough of Dartford) Order 2001(5) is revoked.
3.-(1) The Secretary of State designates each of the areas mentioned in paragraph (2) as-
(a)a civil enforcement area for parking contraventions; and
(b)a special enforcement area.
(2) Those areas are-
(a)the parts of the area of The County Council of Durham specified in Schedules 1 and 2;
(b)the part of the area of The East Riding of Yorkshire Council specified in Schedule 3;
(c)the part of the area of The Kent County Council specified in Schedule 4;
(d)the part of the area of The Norfolk County Council specified in Schedule 5; and
(e)the part of the area of The Warwickshire County Council specified in Schedule 6.

Article 3(2)(a)
The following parts of the area of The County Council of Durham-
(a)the part of the area in the north of County Durham bounded by the outer edge of the black line forming the boundary of the hatched area shown in general overview on Plan ND Overview, and more particularly delineated on Plans ND1 to ND4, ND10 and ND11, in Schedule 2 but excluding the section of the A1M road, and at junction 63 its slip roads and circulatory carriageways, that lie within this part of the area; and
(b)the part of the area in the north east of County Durham bounded by the outer edge of the black line forming the boundary of the hatched area shown in general overview on Plan ND Overview, and more particularly delineated on Plans ND 5 to ND9, in Schedule 2 but excluding the section of the A19 road and its slip roads that lie within this part of the area.

The whole of the area of The East Riding of Yorkshire Council except-
(a)the M62 motorway from the boundary with The North Yorkshire County Council at Ordnance Survey National Grid reference point SE6076021285 to its termination at the juncture with the A63 road at Ordnance Survey National Grid reference point SE8756731280 including its slip roads;
(b)the A63 road from its juncture with the M62 motorway at Ordnance Survey National Grid reference point SE8756731280 to the western boundary of Hull City Council at Ordnance Survey National Grid reference point TA0439026035 including its slip roads;
(c)the A15 Humber Bridge approach road, from its junction with the A164 and A1105 roads at Ordnance Survey National Grid reference point TA0190526485 to the Humber Bridge at Ordnance Survey National Grid reference point TA0241524425 including its slip roads; and
(d)the A1033 road from the eastern boundary of Hull City Council at Ordnance Survey National Grid reference point TA1582029000 to the point where the slip roads merge with the main line of the road near Glencoe Villas at Ordnance Survey National Grid reference point TA1707628753 excluding its slip roads.
Article 3(2)(c)
This whole of the area of The Dartford Borough Council except-
(a)the M25 motorway for its entire length within the Borough including all its on and off slip roads;
(b)the A282 Dartford Tunnel Approach Road for its entire length within the Borough including all its on and off slip roads;
(c)the A2 trunk road for its entire length within the Borough including all its on and off slip roads;
(d)the B255 St Clements Way from its junction with the A226 London Road to its junction with the B255 Bean Road including the on slip road leading from the Bluewater shopping complex onto the B255 St Clements Way;
(e)the area known as Bluewater, a shopping complex, the boundary of which is indicated by the following roads, which are not themselves part of the area known as Bluewater-
(i)Hedge Place Road, which indicates the northern boundary of the area;
(ii)Watling Street, which indicates the southern boundary of the area;
(iii)St James Lane, which indicates the western boundary of the area;
(iv)St Clements Way, which indicates the eastern boundary of the area;
(f)the A226 road from the Thames Way roundabout junction with Stonebridge Road and Grove Road at Ordnance Survey National Grid reference point TQ6147074704 to its junction with Springhead Road at Ordnance Survey National Grid reference point TQ6238073451;

(a)the A11 road from the boundary with Suffolk County Council at Elvedon Gap at Ordnance Survey National Grid reference point TL8396381035 to its termination point at the junction with the A47 road at Cringleford, Norwich at Ordnance Survey National Grid reference point TG1849805516 including its slip roads;
(b)the A12 road from the boundary with Suffolk County Council at the junction with Jay Lane at Ordnance Survey National Grid reference point TM5266899374 to its termination point at the junction with Vauxhall Roundabout in Great Yarmouth at Ordnance Survey National Grid reference point TG5183908450 including its slip roads; and
(c)the A47 road from the boundary with Cambridgeshire County Council immediately southwest of the junction with the A1101 road at Ordnance Survey National Grid reference point TF4709607800 to its termination point at the junction with the A149 road at Vauxhall Roundabout in Great Yarmouth at Ordnance Survey National Grid reference point TG5186808448 including its slip roads.

The whole of the area of The Nuneaton and Bedworth Borough Council(6) except-
(a)the M6 motorway from the boundary with Coventry City Council at Ordnance Survey National Grid reference point SP3524384575 to the boundary with North Warwickshire Borough Council at Ordnance Survey National Grid reference point SP3197185846 including its slip roads;
(b)the A5 road from the boundary with Leicestershire County Council at Ordnance Survey National Grid reference point SP3961593279 to the boundary with North Warwickshire Borough Council at Ordnance Survey National Grid reference point SP3671094991; and
(c)the A444 road from the boundary with Coventry City Council at Ordnance Survey National Grid reference point SP3407583792 to the roundabout junction with the A4254 road at Ordnance Survey National Grid reference point SP3615790855.
(This note is not part of the Order)
This Order designates part of the area of each of The County Council of Durham, The East Riding of Yorkshire Council, The Kent County Council, The Norfolk County Council and The Warwickshire County Council as a civil enforcement area for parking contraventions and as a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004.
It simultaneously revokes the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Kent) (Borough of Dartford) Order 2001 (S.I. 2001/1855) made under the predecessor designation scheme contained in the Road Traffic Act 1991. The same area as that previously designated by the 2001 Order is re-designated under the Traffic Management Act 2004 by this Order with minor further exclusions inserted relating to the A226 and the A2260 roads in the vicinity of Ebbsfleet International Station.
An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on the UK legislation website, www.legislation.gov.uk.
By the County Durham (Structural Change) Order 2008 (S.I. 2008/493), the County Durham council was appointed as the single tier council for the whole county with effect from 1st April 2009. All other local government areas within the county were simultaneously abolished and all other councils were wound up and dissolved. For the purposes of enactments relating to local government, the Order created a new district called County Durham whose area is coterminous with that of County Durham.
The Humberside (Structural Change) Order (S.I. 1995/600) abolished the county of Humberside and created a new non-metropolitan district and a corresponding district council of the East Riding of Yorkshire and a new county of the East Riding of Yorkshire. On 5th July 1995 the Council passed a resolution to change its name to "The East Riding of Yorkshire Council" in accordance with section 74 of the Local Government Act 1972 (c.70). The county of the East Riding of Yorkshire has no county council (see article 5(2) of S.I. 1995/600). Reference to "a county council" is construed as including a reference to a district council by virtue of regulation 5(1) and (6) of the Local Government Changes for England Regulations 1994 (S.I. 1994/867, to which relevant amendments were made by S.I. 1995/1748, 1996/330, 1996/611 and 2008/2867). The East Riding of Yorkshire Council is accordingly entitled to apply to the Secretary of State for designation of all or part of its area by virtue of paragraph 8(2)(a) of Schedule 8, and paragraph 3(3)(a) of Schedule 10, to the Traffic Management Act 2004.
The Secretary of State is, by virtue of section 92 of the Traffic Management Act 2004, the -�appropriate national authority' as regards England for the purposes of Part 6 of that Act.
On 2nd July 1980 The Nuneaton Borough Council passed a resolution to change its name to "The Nuneaton and Bedworth Borough Council" with effect from 1st October 1980.
