The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 272(7) and 273(1) of, and paragraph 10 of Schedule 4 to, the National Health Service Act 2006(1).
1. This Order may be cited as the National Health Service Trusts (Trust Funds: Appointment of Trustees) (Amendment) Order 2013 and comes into force on 1st April 2013.
2. In article 4(1) of, and in the Schedule to, the National Health Service Trusts (Appointment of Trustees) Order 2000(2) for "Barts and The London National Health Service Trust", substitute "Barts Health National Health Service Trust"(3).

This Order amends the National Health Service Trusts (Trust Funds: Appointment of Trustees) Order 2000 ("the Appointment Order"), which provides for the appointment of trustees for National Health Service trusts specified in the Schedule and provides that the Secretary of State must not appoint a company as trustee except in relation to the Barts and The London National Health Service Trust.
Article 2 amends the Appointment Order to replace references to the Barts and The London National Health Service Trust, which has been dissolved, with references to the Barts Health National Health Service Trust. The staff, property and liabilities of the Barts and The London National Health Service Trust have been transferred to the Barts Health National Health Service Trust and the effect of this Order is that the Secretary of State must appoint trustees to Barts Health NHS Trust and the trustees so appointed may be a company.
2006 c.41. The powers of the Secretary of State under those provisions are exercisable only in relation to England, by virtue of section 271(1) of the Act.
S.I. 2000/212, relevant amending instruments are S.I. 2000/3116 and 2010/589.
Established by S.I. 2012/796 which also dissolved the Barts and The London National Health Service Trust.
