The Lord Chancellor makes the following Order in exercise of the power conferred by sections 60 and 61(3) of the Crime and Courts Act 2013(1).

Citation

1.  This Order may be cited as the Crime and Courts Act 2013 (Commencement No. 10 and Transitional Provision) Order 2014.

Provisions coming into force on 22nd April 2014

2.  The following provisions of the Crime and Courts Act 2013, so far as not already in force, come into force on 22nd April 2014-

(a)section 17 (Civil and family proceedings in England and Wales);

(b)section 28 (Disclosure of information for calculating fees of courts, tribunals, etc.);

(c)Schedule 9 (Single County Court in England and Wales);

(d)Schedule 10 (The family court);

(e)Schedule 11 (Transfer of jurisdiction to family court).

Transitional provision

3.  Any judgment, order, warrant, direction or other act of a county court before 22nd April 2014 (except one in relation to proceedings under jurisdiction transferred to the family court established under section 31A of the Matrimonial and Family Proceedings Act 1984(2)) is to have the same effect on and after that date as if it had been a judgment, direction, order or other act of the county court established under section A1 of the County Courts Act 1984(3).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the tenth commencement order made under the Crime and Courts Act 2013 (c. 22) ("the Act"). It brings into force sections 17 and 28 of and Schedules 9, 10 and 11 to the Act.

Section 17, together with Schedule 9, 10 and 11 which it introduces, makes provision for the establishment of a single County Court for England and Wales, replacing the structure of individual county courts for specific districts, and for the establishment of a family court, replacing the structure of family proceedings spread across magistrates' court, county courts and the High Court.

Section 28 makes provision to enable social security information, or tax credit or finances information, to be disclosed for the purposes of determining an application for remission of certain fees.

This Order also makes transitional provision to ensure that things done by an individual county court operate appropriately as references to the single County Court (except for things done in relation to proceedings under jurisdiction transferred to the family court, for which separate transitional provision is being made).
