The Plant Health (Forestry) (Miscellaneous Revocations) (England) Order 2015

The Forestry Commissioners make this Order in exercise of the powers conferred by sections 3(1), (2) and (4) and 5(1) of the Plant Health Act 1967(1).

Title, commencement and application

1.-(1) This Order may be cited as the Plant Health (Forestry) (Miscellaneous Revocations) (England) Order 2015 and comes into force on 1st July 2015.

(2) This Order applies in relation to England only.

Revocation

2.  The following Orders are revoked-

(a)the Watermark Disease (Local Authorities) Order 1974(2);

(b)the Increase of Fines (Plant Health) (Forestry) Order 1984(3); and

(c)the Watermark Disease (Local Authorities) (Amendment) Order 1992(4).

This Order revokes, in relation to England, the three instruments listed in article 2.

1967 c.8; section 3(1) and (2) was amended by the European Communities Act 1972 (c.68), Schedule 4, paragraph 8 and section 3(1) was further amended by S.I. 2011/1043, article 6(1). Section 3(4) was substituted by the Criminal Justice Act 1982 (c.48), section 42 and amended by the Statute Law (Repeals) Act 1993 (c.50), Schedule 1, Part XIV. The powers conferred by sections 3 and 5 are conferred on a "competent authority", which is defined in section 1(2). Section 1(2) was amended by article 4(1) of, and paragraph 43 of Schedule 2 to, the Natural Resources Body for Wales (Functions) Order 2013 (S.I. 2013/755). Under section 1(2), as amended, the Forestry Commissioners are the competent authority for England (and Scotland) as regards the protection of forest trees and timber from attack by pests.
