The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and section 56(1) of the Finance Act 1973(2).
The Secretary of State has been designated(3) for the purposes of section 2(2) of the European Communities Act 1972 in relation to the control of the import and export of goods.
In accordance with section 56(1) of the Finance Act 1973, the Treasury consents to the making of these Regulations.
1. These Regulations may be cited as the Forest Law Enforcement, Governance and Trade (Amendment) Regulations 2016 and come into force on 1st November 2016.
2.-(1) The Forest Law Enforcement, Governance and Trade Regulations 2012(4) are amended as follows.
(2) In regulation 5A, for "£31" substitute "£9.60".
(3) In regulation 13, for paragraph 4 substitute-
"(4) The first report under this regulation must be published on or before 20th February 2022."

These Regulations amend the Forest Law Enforcement, Governance and Trade Regulations 2012 (S.I. 2012/178) ("the principal Regulations") which enforce Council Regulation (EC) No. 2173/2005 on the establishment of a FLEGT licensing scheme for imports of timber into the European Community (OJ No. L 347, 30.12.2005, p. 1) and Commission Regulation (EC) No. 1024/2008 laying down detailed measures for the implementation of Council Regulation (EC) No. 2173/2005 (OJ No. L 277, 18.10.2008, p. 23).
Regulation 2 amends regulation 5A (Fee for the verification of a FLEGT licence) of the principal Regulations so as to reduce the fee that is payable to the Secretary of State on an application for verification of a FLEGT licence from £31 to £9.60.
Regulation 2 also amends regulation 13 (Review) of the principal Regulations so as to extend the deadline by which the Secretary of State is required to publish the first report under that regulation to 20th February 2022.

This includes an assessment of the effect of the future introduction of a fee for the verification of a FLEGT licence.
