The Planning Act 2008 (Commencement No. 3) (England) Order 2017

The Secretary of State makes this Order in exercise of the power conferred by section 241(8) of the Planning Act 2008(1):

Citation

1.  This Order may be cited as the Planning Act 2008 (Commencement No. 3) (England) Order 2017.

Provisions coming into force on 1st January 2018 in relation to England only

2.  The following provisions of the Planning Act 2008 (so far as they are not yet in force) shall come into force, in relation to England only, on 1st January 2018-

(a)section 14(1)(m) (nationally significant infrastructure projects: the construction or alteration of a dam or reservoir) ;

(b)section 14(1)(n) (nationally significant infrastructure projects: development relating to the transfer of water resources);

(c)section 27 (dams and reservoirs); and

(d)section 28 (transfer of water resources).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force provisions of the Planning Act 2008 which determine when development relating to the transfer of water resources or to the construction or alteration of a dam or reservoir will constitute a nationally significant infrastructure project for the purposes of the Planning Act 2008.
