The Secretary of State makes this Order in exercise of the powers conferred by section 1(5) and (6) of the Dangerous Dogs Act 1991( 1).

Citation, commencement and extent

1.—(1) This Order may be cited as the Dangerous Dogs (Exemption Schemes and Miscellaneous Provisions) (England and Wales) (Amendment) Order 2024.

(2) This Order comes into force on 12th January 2024.

(3) This Order extends to England and Wales.

Amendment of the Dangerous Dogs (Exemption Schemes and Miscellaneous Provisions) (England and Wales) Order 2023

2.—(1) The Dangerous Dogs (Exemption Schemes and Miscellaneous Provisions) (England and Wales) Order 2023( 2) is amended as follows.

(2) In article 2 (interpretation), for the definition of “rehoming organisation” substitute—

rehoming organisation ” means an organisation—

(a)

whose purposes are, or include—

(i)

the provision of care to dogs that have been abandoned or relinquished by their previous owners; and

(ii)

the rehoming of dogs taken into the organisation’s care; and

(b)

which was carrying on the activities described in paragraph (a)(i) and (ii) on 31st October 2023. .

(3) In article 4 (application for a certificate of exemption)—

(a) in paragraph (1), for “31st October 2023” substitute “30th December 2023”;

(b) in paragraph (4), in sub-paragraphs (a) and (c), for “15th January 2024” substitute “22nd January 2024”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Dangerous Dogs (Exemption Schemes and Miscellaneous Provisions) (England and Wales) Order 2023 (> S.I 2023/1407). It amends Part 2 of that Order to make provision for a rehoming organisation that was established and operating as a rehoming organisation on 31st October 2023 to apply for a certificate of exemption in respect of dogs of the type known as the XL Bully that were taken into its care before 31st December 2023. It also extends the date by which applications for any such certificate may be made to 22nd January 2024.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
