The Local Authorities (Members' Allowances) (Amendment) (Wales) Regulations 2001

  Made 25th July 2001 
  Coming into force 1st August 2001 

The National Assembly for Wales makes the following Regulations in exercise of the powers given to the Secretary of State by sections 173(1), (2) and (4) and 175(1A) of the Local Government Act 1972[1] which are now vested in the National Assembly for Wales so far as exercisable in Wales[2].

Name, commencement and application
     1.  - (1) The name of these Regulations is the Local Authorities (Members' Allowances) (Amendment) (Wales) Regulations 2001 and they shall come into force on 1st August 2001.

    (2) These Regulations apply to Wales only.

Amendments
    
2.  - (1) The Local Authorities (Members' Allowances) Regulations 1991[3] are amended in accordance with the following paragraphs.

    (2) In Regulation 17, in paragraph (2), for "£30.39 "substitute "£31.39".

    (3) In Regulation 18,

Revocation
     3. The Local Authorities (Members' Allowances) (Amendment) Regulations (Wales) 2000[4] are revoked.

EXPLANATORY NOTE

(This note does not form part of the Regulations)


Section 173 of the Local Government Act 1972 makes provision for a member of, in England, a parish or, in Wales, a community council who is a councillor to receive a payment by way of attendance allowance which does not exceed the amount prescribed by regulations and for a member of such a council who is not entitled to receive such a payment to receive a payment by way of financial loss allowance which does not exceed the amount prescribed by regulations.

Section 175 of the 1972 Act makes provision for the payment to a member of a local authority or of any other body to which that section applies of an allowance for attending a conference or meeting which does not exceed such amount as may be specified in or determined under regulations.

Regulation 17 of the Local Authorities (Members' Allowances) Regulations 1991 specifies an amount for the purpose of section 175 of the 1972 Act and Regulation 18 of those Regulations prescribes amounts for the purposes of section 173 of that Act.

These Regulations amend Regulations 17 and 18 of the 1991 Regulations by increasing the relevant amounts and revoke the Local Authorities (Members' Allowances) (Amendment) (Wales) Regulations 2000.
