The Food Hygiene (Wales) (Amendment) Regulations 2007

  Made 13 February 2007 
  Coming into force 14 February 2007 

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1].

     The National Assembly for Wales has been designated[2] for the purposes of that section in relation to measures relating to food (including drink) including the primary production of food.

     As required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety[3] there has been open and transparent public consultation during the preparation of the following Regulations.

Title and commencement
     1. The title of these Regulations is the Food Hygiene (Wales) (Amendment) Regulations 2007 and they come into force on 14 February 2007.

Amendments to the Food Hygiene (Wales) Regulations 2006
    
2. —(1) The Food Hygiene (Wales) Regulations 2006[4] are amended in accordance with paragraphs (2) and (3).

    (2) In paragraph (1) of regulation 2 (interpretation) for the definitions of the Community instruments appearing immediately after the definition of "premises" there are substituted in the appropriate place in the alphabetical order the following definitions—

    (3) For Schedule 1 (definitions of Community legislation) there is substituted the Schedule set out in the Schedule to these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)


     1. These Regulations amend the Food Hygiene (Wales) Regulations 2006 (S.I. 2006/31 (W.5)) by updating the definitions of certain Community instruments that are referred to in those Regulations.

     2. The definitions are updated by—

     3. A full Regulatory Appraisal on the effect that these Regulations will have on the costs of business has been prepared and placed in the Library of the National Assembly for Wales. Copies may be obtained from the Food Standards Agency, 11th Floor, Southgate House, Wood Street, Cardiff, CF10 1EW.
