The Welsh Ministers, in exercise of the powers conferred upon the National Assembly for Wales by section 250(2)(a) of, and Schedule 13 to, the Housing Act 2004(1), and now vested in them(2), make the following Regulations.

Title, commencement and application

1.  (1)  The title of these Regulations is the Residential Property Tribunal Procedures and Fees (Wales) (Amendment) Regulations 2014 and they come into force on 10 March 2014.

(2) These Regulations apply in relation to Wales.

Amendment of the Residential Property Tribunal Procedures and Fees (Wales) Regulations 2012

2.  (1)  The Residential Property Tribunal Procedures and Fees (Wales) Regulations 2012(3) are amended in accordance with paragraphs (2) to (4).

(2) In regulation 49(2) (liability to pay fee and waiver of fees)-

(a)remove the full stop at the end of sub-paragraph (e); and

(b)after sub-paragraph (e), insert-

"; or

(f)universal credit."

(3) In paragraph 13 of the Schedule-

(a)in sub-paragraph (2)(a)(iv) after the words "housing benefit" insert "or universal credit"; and

(b)in sub-paragraph (2)(b)(i) after the words "housing benefit" insert "or universal credit".

(4) In paragraph 19 of the Schedule-

(a)in sub-paragraph (2)(a)(iv) after the words "housing benefit" insert "or universal credit"; and

(b)in sub-paragraph (2)(b)(i) after the words "housing benefit" insert "or universal credit".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments to the Residential Property Tribunal Procedures and Fees (Wales) Regulations 2012 (S.I. 2012/531) ("the Principal Regulations") as a result of the introduction of universal credit by Part 1 of the Welfare Reform Act 2012.

Regulation 49 is amended so as allow the receipt of universal credit to be taken into account when determining whether a tribunal fee may be waived.

The Schedule to the Principal Regulations is also amended so as to include proof of payment of universal credit within the list of specified documents required to accompany certain applications listed within that Schedule.

Powers of the National Assembly for Wales under the Housing Act 2004 were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c.32).
