The Welsh Ministers, in exercise of the powers conferred on them by section 56(4) of the Agriculture (Wales) Act 2023( 1), make the following Order:
1.—(1) The title of this Order is the Agriculture (Wales) Act 2023 (Commencement No. 1 and Savings Provisions) Order 2023.
(2) In this Order, “ the Act” means the Agriculture (Wales) Act 2023.
2. The following provisions of the Act come into force on 17 October 2023—
(a) sections 21 to 23 (Intervention in agricultural markets);
(b) sections 25-33 (Collection and sharing of data);
(c) section 34 (Marketing Standards);
(d) section 35 (Carcass classification);
(e) section 55 (Consequential amendments and repeals etc.);
(f) Schedule 1 (Agricultural products relevant to marketing standards provisions);
(g) Schedule 2 (Minor and Consequential Amendments etc. relating to Parts 1 to 3) to the extent it is not already in force;
(h) Schedule 3 (Consequential amendments etc. to the CMO Regulation).
3. The following provisions of the Act come into force on 1 April 2024—
(a) sections 36-44 (Forestry) to the extent that they are not already in force.
4. Despite the repeal of Schedule 5 to the Agriculture Act 2020 by paragraph 1(9) of Schedule 2 to the Act, regulations and declarations specified in column 1 of the Schedule to this Order continue in force and have effect as if they had been made under the section of the Act specified in Column 2 of the Schedule.

This Order, made by the Welsh Ministers, brings into force certain provisions of the Agriculture (Wales) Act 2023( 2) (“ the Act”).
Article 2 of this Order brings the following provisions of the Act into force on 17 October 2023—
(a) sections 21 to 23 (Intervention in agricultural markets);
(b) sections 25-33 (Collection and sharing of data);
(c) section 34 (Marketing Standards);
(d) section 35 (Carcass classification);
(e) section 55 (Consequential amendments and repeals etc.);
(f) Schedule 1 (Agricultural products relevant to marketing standards provisions);
(g) Schedule 2 (Minor and Consequential Amendments etc. relating to Parts 1 to 3) to the extent that it is not already in force;
(h) Schedule 3 (Consequential amendments etc. to the CMO Regulations).
Article 3 of this Order brings the following provisions into force on 1 April 2024—
(a) sections 36-44 (Forestry) to the extent they are not already in force.
Article 4 provides saving provisions in relation to regulations or declarations made under existing provisions in Schedule 5 to the Agriculture Act 2020 which is repealed by the Act.
