The Minister for the Environment in exercise of the powers conferred on him by section 12 of the Roads Act, 1920, sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952), section 38 of the Local Government Act, 1955 (No. 9 of 1955), and sections 5 , 42 and 80 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following regulations and order:--

Citation.

1. This Order may be cited as the Mechanically Propelled Vehicles (International Circulation) Order, 1992.

Commencement.

2. This Order shall come into operation on the 1st day,of January, 1993.

Revocations.

3. The Orders specified in the First Schedule to this Order are hereby revoked to the extent specified in the third column of that Schedule, but any application or declaration made, driving licence or permit granted, document or registration plate issued, shall, if in force immediately before the coming into operation of this Order, continue in force and have effect as if the Scheduled Orders had not been revoked.

Definitions.

4. (1) In this Order--

"the Act of 1952" means the Finance (Excise Duties) (Vehicles) Act, 1952 .

"the Automobile Association" means the Automobile Association of Suffolk Street, Dublin.

"bureau" means a central organisation established by motor insurers in any country outside the State for the purpose of giving effect to international agreements for facilitating compliance by visitors with the laws of countries requiring motorists to insure against third party risks, between whom and the Irish bureau there is in force for the time being an agreement whereby, in particular, the Irish Bureau agrees to accept in the State on behalf of the said central organisation the same legal liability in respect of an international insurance card as is placed on a vehicle insurer under the Road Traffic Act, 1961 in respect of a certificate of insurance issued by an insurer in accordance with section 66 of the Road Traffic Act, 1961 certifying that an approved policy of insurance has been issued;

"the Convention of 1949" means the international convention on road traffic concluded at Geneva on the 19th day of September, 1949;

"driving licence" means a driving licence under Part III of the Road Traffic Act, 1961 ;

"domestic driving licence" means a valid and properly completed permit or licence to drive mechanically propelled motor vehicles (not being a provisional permit or licence issued to a person to enable him to learn to drive) issued to a visitor by the competent authority of the State in which he resides or by an association duly empowered by such authority to issue the permit or licence;

"driving permit" means a domestic driving licence or an international driving permit;

"international driving permit" means a valid and properly completed international driving permit issued to a visitor under the Convention of 1949 by the competent authority of the State in which he resides, or by an association duly empowered by such authority to issue such permit;

"international motor insurance card" means a duly completed international motor insurance card issued by a bureau or by the Irish Bureau in, or substantially in, the form set out in the Second Schedule to this Order;

"the Irish Bureau" means the Motor Insurer's Bureau of Ireland of ¾ South Frederick Street, Dublin;

"the Minister" means the Minister for the Environment;

"motor vehicle duty" means the duty of excise imposed by section 1 of the Finance (Excise Duties) (Vehicles) Act, 1952 ;

"provisional licence" means a provisional licence under Part III of the Road Traffic Act, 1961 ;

"the Regulations of 1989" means the Road Traffic (Licensing of Drivers) Regulations, 1989 ( S.I. No. 285 of 1989 );

"relevant evidence of insurance" in respect of a vehicle means--

( a ) an international motor insurance card valid in the State in respect of the vehicle, or

( b ) a certificate of insurance within the meaning of the Road Traffic Act, 1961 , showing that there is in force either an approved policy of insurance covering the driving of the vehicle by the owner of the vehicle (as defined in the Road Traffic Act, 1961 ) or by other persons on his order or with his consent in a public place.

"vehicle" means a mechanically propelled vehicle;

"visitor" means a person resident outside the State making a temporary stay in the State.

(2) The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

Exemption (motor vehicle duty).

5. (1) A vehicle which is brought temporarily into the State by a visitor and which--

( a ) is for the time being licensed in the country of normal residence of the owner of the vehicle in accordance with the relevant legal vehicle licensing provisions in place in the country concerned, and

( b ) is duly registered and displays registration plates in compliance with the regulations for the time being in force in the country concerned,

shall be exempt from motor vehicle duty during any period for which the vehicle is exempt from registration under Part II, Chapter IV, of the Finance Act, 1992 or for a period of three hundred and sixty-five days from the day on which the vehicle was brought into the State, whichever is the lesser, provided (a) the licence issued in the country concerned is exhibited on the vehicle; and (b) the vehicle and any trailer attached thereto carries an identification mark in accordance with the regulations for the time being in force in the country concerned and a nationality plate in accordance with the Convention of 1949 showing the distinctive letters assigned to the country concerned under that Convention.

(2) A vehicle temporarily registered in the State shall be exempt from motor vehicle duty and the obligation to display a licence issued under Section 1 of the Act of 1952 provided the vehicle displays an identification mark incorporating the letters ZZ to the front and rear of the vehicle.

Public Service Vehicles.

6. (1) Article 5 of the Road Traffic (Public Service Vehicles) Regulations, 1963 ( S.I. No. 191 of 1963 ) shall not apply to a vehicle brought into the State temporarily by a visitor if the vehicle is licensed in the State in which it is registered under the licensing requirements (if any) of that State corresponding to those of Part III of the Road Traffic (Public Service Vehicles) Regulations, 1963.

(2) Sub-article (5) of article 62 of the Road Traffic (Public Service Vehicles) Regulations, 1963 shall not apply to a visitor in respect of his employment as driver of a vehicle to which sub-article (1) of this article applies if such person is licensed as such in the State in which he is ordinarily resident under the special licensing requirements (if any) of that State governing the driving of vehicles used for the carriage of passengers for reward.

Application of Road Traffic Regulations.

7. The provisions of the regulations specified in Part 1 of the Third Schedule to this Order shall not apply to a vehicle registered in a State which is a party to the Convention of 1949 in relation to Ireland, which is brought temporarily into the State by a visitor and which complies with the provisions of Chapter IV of the Convention of 1949 and the requirements contained in Part II of the said Schedule.

Insurance Certificate or Card.

8. (1) In this article--

"certificate" means a certificate of insurance issued in accordance with section 66 of the Road Traffic Act, 1961 by a vehicle insurer certifying that an approved policy of insurance has been issued.

(2) For the purposes of Part VI of the Road Traffic Act, 1961 , section 12 of the Roads Act, 1920 and any regulation made under any of the said enactments, the following provisions shall apply regarding an international motor insurance card in respect of the use of the vehicle referred to in the said card:--

( a ) the said card shall be deemed to be evidence that a certificate issued to the insured named thereon for the period shown thereon as the period of validity in Ireland;

( b ) the Irish Bureau shall be deemed to be the vehicle insurer which issued the evidence that a certificate was issued, and to be competent to act as a vehicle insurer;

( c ) notwithstanding anything contained in section 66 of the Road Traffic Act, 1961 , or the regulations made thereunder, it shall not be necessary to furnish any particulars on an international motor insurance card other than those required to be furnished on the said card.

(3) Section 58 of the Road Traffic Act, 1961 shall not apply to the Irish Bureau and paragraphs (3) and (8) of article 7 of the Road Traffic (Compulsory Insurance) Regulations, 1962 shall not apply to an international insurance card.

Driving Licence or Permit.

9. (1) A visitor who is for the time being the holder of a driving permit may drive in a public place a vehicle which he is licensed by the driving permit to drive, other than a vehicle of a category in respect of which he is disqualified for holding a driving licence, and section 38 of the Road Traffic Act, 1961 , shall be modified accordingly.

(2) Part III of the Road Traffic Act, 1961 modified as follows, shall apply in respect of the driving permit of a visitor in like manner as it applies in respect of a driving licence--

( a ) Sections 22, 23, 24, 25, subsection (2) of section 28, subsections (2) and (3) of section 31, sections 36 and 39 and subsection (5) of section 40 shall not apply to a driving permit.

( b ) Notwithstanding the provisions of section 30 with respect to the suspension of a driving licence, whenever a visitor who holds a driving permit is disqualified under section 26, 27 or 28 for holding any driving licence in respect of a category or categories of mechanically propelled vehicles comprising any vehicle which the driving permit licenses him to drive, the driving permit shall stand suspended.

( c ) An order under section 26 or 27 disqualifying a person for holding a driving licence during a specified period and thereafter until the person produces a certificate of competency shall not be made, and the appropriate authority for the purpose of those sections shall be the Automobile Association.

( d ) An application for an order under subsection (1) of section 28 may be made to any Justice of the District Court, and the appropriate authority for the purpose of that section shall be the Automobile Association.

( e ) The following words shall be omitted from subsection (4) of section 34-- "but, where the issuing authority so thinks proper, it may defer a decision under this subsection pending production by the applicant of a certificate of competency".

( f ) In paragraph (a) of subsection (5) of section 34 there shall be substituted "any Justice of the District Court" for "a Justice of the District Court having jurisdiction in the place in which such person ordinarily resides".

( g ) For the purpose of section 37, an endorsement authorised to be made on a driving permit under this article shall be deemed to be an endorsement made on a driving licence under Part III.

(3) Parts I and V of the Regulations of 1989, shall apply in respect of a driving permit and the visitor who holds such a permit in like manner as they apply in respect of a driving licence and the holder of such licence.

(4) Where a consequential, ancillary or special disqualification order is made, confirmed, varied or annulled or the disqualification is removed in respect of the holder of a driving permit, Part VI of the Regulations of 1989, modified as follows, shall apply in respect of a driving permit in like manner as it applies in respect of a driving licence:--

( a ) where a provision requires that a licence, having been endorsed by the officer of the court, shall be sent by him to the licensing authority which issued it or returned it to the licensee, there shall be substituted a provision requiring that the driving permit, together with particulars of the disqualification or its annulment or removal, as the case may be, shall be sent by the Officer of the court to the automobile Association;

( b ) on receipt of a driving permit pursuant to sub-paragraph (a) of this paragraph, the Automobile Association shall retain it until it expires or until the period of disqualification ceases or until the visitor leaves the State, whichever is the earlier, and shall, before returning the driving permit to the holder, make an endorsement on the part thereof reserved for endorsements or, if there is no such part, on the back thereof, to the effect that the right to use the permit in the State was withdrawn for the period involved.

(5) The holder of a driving permit shall be a qualified person for the purpose of article 19 of the Regulations of 1989.

Visitor's Driving or Provisional Licence.

10. (1) In respect of the grant of a visitor's driving licence or a visitor's provisional licence and the holding of such licences, the Road Traffic Act, 1961 and the Regulations of 1989 shall be modified as follows:--

( a ) An application for a visitor's driving licence or a visitor's provisional licence may be made to the Automobile Association.

( b ) The words "Visitor's Driving Licence" shall, in the case of a visitor's driving licence, be inserted in the authorised form referred to in article 16 of the said Regulations.

( c ) The words "Visitor's Provisional Licence" shall, in the case of a visitor's provisional licence, be inserted in the authorised form referred to in article 23 of the said Regulations.

( d ) Sub-article (2) of article 14 of the said regulations shall not apply to a visitor's driving licence.

( e ) The references in sub-article (4) of article 15 of the said Regulations to a driving licence shall (in respect of an application for a visitor's driving licence) be construed as if it included a reference to a driving permit.

( f ) Paragraph (a) of sub-article (1) of article 29 of the said Regulations shall (in respect of an application for a visitor's driving licence) be construed as if the reference to a driving licence in respect of a category where a reference to a driving permit issued in respect of that category or in respect of a category of vehicles which includes vehicles of that category or the majority of vehicles of that category.

(2) The reference in paragraph (a) of sub-article (1) of article 29 of the Regulations of 1989, to a driving licence shall not (except in the case of an application for a visitor's driving licence) include a reference to a visitor's driving licence.

(3) ( a ) For the purpose of the grant of a visitor's driving licence, in any of the enactments specified in (sub-paragraph (b)) of this paragraph the term "licensing authority" shall include the Automobile Association.

( b ) The enactments referred to in sub-paragraph (a) of this paragraph are -- the Roads Act, 1920, the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952), the Road Traffic Act, 1961 and the orders and regulations made under the said Acts.

(4) As regards any excise duty or fees collected by the Automobile Association under the enactments referred to in paragraph (3) of this article, the following provisions shall apply in lieu of the corresponding provisions of the said enactments which apply generally to licensing authorities:--

( a ) the sums so collected shall be paid by such body to the Minister at such times and in such manner as he shall from time to time direct, and the sums so paid shall be lodged by him to the credit of the Central Fund;

( b ) such body shall keep such accounts and make such returns in relation to the sums so collected as the Minister shall from time to time direct.

(5) In this article:--

"visitor's driving licence" means a driving licence granted to a person ordinarily resident outside the State;

"visitor's provisional licence" means a provisional licence granted to a person ordinarily resident outside the State.

International Driving Permit.

11. As respects vehicles registered in the State and persons holding driving licences (other than driving licences on which the words "Visitor's Driving Licence" have been added) the automobile Association is hereby authorised to issue international driving permits under and in accordance with the Convention of 1949 and in accordance with any directions given from time to time by the Minister and to charge for each permit a fee of four pounds (£4).

THIRD SCHEDULE

PART I

Provisions which are not to apply to a vehicle registered in a State which is a party to the Convention of 1949:

1. The Road Traffic (Lighting of Vehicles) Regulations, 1963.

2. The provisions of Parts I to VI of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963, other than those provisions relating to--

( a ) the weight, width, length and height of vehicles,

( b ) the weight, width, length and height of trailers attached to vehicles,

( c ) the weight, width, length and height of combinations of vehicles,

( d ) the number of trailers attached to vehicles.

PART II

Requirements to be complied with by a vehicle registered in a State which is a party to the Convention of 1949:

1. The lights referred to in the Convention of 1949 shall be carried duly lit and in an efficient condition in the same circumstances as the corresponding obligatory lighting under the Road Traffic (Lighting of Vehicles) Regulations, 1963 would be required to be carried duly lit.

2. A vehicle (and any trailer attached thereto) shall not show a red light or a red reflector to the front or a white reflector or (save where the showing of such a light would be lawful under the Road Traffic (Lighting of Vehicles) Regulations, 1963) a white light to the rear.

EXPLANATORY NOTE.

This Order makes provision for the licensing of visiting drivers and the exemption from road tax of temporarily imported motor vehicles. The Order takes account of the responsibility of the Revenue Commissioners for the registration of temporarily imported motor vehicles -- including the assignment of ZZ numbers by the AA (as agents for the Revenue Commissioners), with effect from 1st January, 1993.

The Order also provides for recognition of "green card" insurance as evidence of insurance in the case of temporarily imported motor vehicles from outside the EC or designated European countries. Vehicles registered in the EC or in the designated European Countries are automatically deemed to be insured under the European Communities (Road Traffic) (Compulsory Insurance) Regulations, 1975, -- S.I. No. 178 of 1975 ; and do not need "green cards". The designated European countries are Austria, Czechoslovakia, Finland, Hungary, Norway, Sweden, and Switzerland.

The Order also exempts visiting vehicles from certain provisions of Road Traffic Act Regulations relating to the construction, equipment and lighting of motor vehicles; and to public service vehicles.

The Order consolidates, with amendments, nine previous Orders dating back to 1961.
