European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) (Amendment) Regulations, 2002.

I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 ( No 27 of 1972 ), and for the purposes of giving effect to Commission Directive 2002/1/EC of 7 January 20021 , and for the purposes of giving further effect to Council Directive 93/74/EC of 13 September 19932 , as amended, hereby make the following Regulations.

1.       (1)         These Regulations may be cited as the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) (Amendment) Regulations, 2002.

(2)         The European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 to 2000 and these Regulations may be cited collectively as the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 to 2002.

(3)         These Regulations shall come into operation on 1st day of August, 2002.

2.       In these Regulations “the Regulations of 1996” means the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 ( S.I. No. 59 of 1996 ).

3.       Regulation 2(1) of the Regulations of 1996 is hereby amended by the substitution, for the definition of “the Directive”, of the definition set out in the First Schedule to these Regulations.

4.   The Regulations of 1996 are hereby amended by the substitution, in Part B of the First Schedule thereto, of the provisions set out in the Second Schedule to these Regulations.

FIRST SCHEDULE

“the Directive” means Council Directive 93/74/EEC of 13 September, 19933 , as amended by:-

Commission Directive 94/39/EC of 25 July, 19944 ;

Commission Directive 95/9/EC of 7 April, 19955 ;

Commission Directive 95/10/EC of 7 April, 19956 ;

Council Directive 96/25/EC of 29 April, 19967 ,

Council Directive 99/78/EC of 27 July 19998 ,

Commission Directive 2002/1/EC of 7 January 20029 .

SECOND SCHEDULE

The provisions set out in the Part B of the Schedule to the Regulations of 1996 in respect of the particular nutritional purpose “Support of liver function in case of chronic liver insufficiency” concerning dogs and cats shall be replaced by the following:-

-  High quality protein, moderate level of protein, high level of essential fatty acids and high level of highly digestible carbohydrates

-  Highly digestible carbohydrates including their treatment if appropriate

-  Sodium

-  Total copper

Initially up to 6 months

Indicate on the package, container or label:

“It is recommended that a veterinarian's opinion be sought before use or before extending the period of use”.

Indicate in the instructions for use:-

“Water should be available at all times”.

-  High quality protein, moderate level of protein, and high level of essential fatty acids

Cats

-  Protein sources(s)

-  Content of essential fatty acids

-  Sodium

-  Total copper

Initially up to 6 months

Indicate on the package, container or label:

“It is recommended that a veterinarian's opinion be sought before use or before extending the period of use”.

Indicate in the instructions for use:-

“Water should be available at all times”.

Explanatory Note

(This is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 so as to give effect to Commission Directive 2002/1/EC which amends the provisions applicable to the particular nutritional purpose “Support of liver function in case of chronic liver insufficiency” in respect of dogs and cats.
