Local Government (An Chomhairle Leabharlanna) (Amendment) Regulations, 2003

The Minister for the Environment and Local Government, in exercise of the powers conferred on him by section 79 of the Local Government Act, 2001 ( No. 37 of 2001 ) hereby makes the following Regulations:--

1.       These Regulations may be cited as the Local Government (An Chomhairle Leabharlanna) (Amendment) Regulations, 2003.

2.       These Regulations and the Local Government (An Chomhairle Leabharlanna) Regulations, 1997 ( S.I. No. 499 of 1997 ) shall be construed as one and cited together as the Local Government (An Chomhairle Leabharlanna) Regulations, 1997 to 2003.

3.       These Regulations shall come into operation on 29 January, 2003.

4.       (1)     In these Regulations, the “Principal Regulations” means the Local Government (An Chomhairle Leabharlanna) Regulations, 1997 ( S.I. No. 499 of 1997 ).

(2)     Article 3(a) of the Principal Regulations is hereby amended by substituting the following definition for the definition of “local authority”:

‘ “local authority means a local authority for the purposes of the Local Government Act, 2001 ” ’.

5.       Article 5(3) of the Principal Regulations is hereby amended by substituting the following for article 5(3):

“5(3)  The other members shall be appointed by the Minister as follows:

(a)     one, who shall be a member of a library authority, on the nomination of the General Council of County Councils,

(b)     one, who shall be a member of a library authority, on the nomination of the Association of Municipal Authorities of Ireland,

(c)     one, who shall be a member of a library authority, on the nomination of the Local Authority Members Association,

(d)     two, each of whom shall be either a member or an officer of a library authority, on the nomination of the Library Association of Ireland,

(e)     one, on the nomination of the Council of Trustees of the National Library of Ireland,

(f)      three, on the nomination of the Higher Education Authority,

(g)     one, on the nomination of the Board of Trinity College, Dublin,

(h)     two, who shall be members of a local authority.”

Explanatory Note

These Regulations amend the Local Government (An Chomhairle Leabharlanna) Regulations, 1997 ( S.I. No. 499 of 1997 ) by altering the numbers and method of selection of the Library Council in relation to the five local authority members. The Regulations provide that the Minister may appoint two local authority members directly to the Council and also allows representation from the Local Authority Members Association for the first time.
