OIREACHTAS (ALLOWANCES TO MEMBERS) AND MINISTERIAL, PARLIAMENTARY, JUDICIAL AND COURT OFFICES (AMENDMENT) ACT 1998 (ALLOWANCES AND ALLOCATIONS) (AMENDMENT) ORDER 2004.

OIREACHTAS (ALLOWANCES TO MEMBERS) AND MINISTERIAL, PARLIAMENTARY, JUDICIAL AND COURT OFFICES (AMENDMENT) ACT 1998 (ALLOWANCES AND ALLOCATIONS) (AMENDMENT) ORDER 2004.

The Government, in exercise of the powers conferred on them by sections 3 (as amended by section 8(5) of section 40 of the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001)), 4 and 8 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (No. 5 of 1998), hereby orders as follows:

1. This Order may be cited as the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (Allowances and Allocations) (Amendment) Order 2004.

2. The Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (Allowances and Allocations) Order 2003 ( S.I. No. 59 of 2003 ) is amended by--

(a) inserting after Article 9 the following Article:

“9A There is payable to a member of the Oireachtas who holds a position as a member of the Houses of the Oireachtas Commission an annual allowance in respect of the member's duties as holder of that position at the rate of €16,511 per year, in respect of any period beginning on 1 January 2004, during which the member holds the position.”,

(b) substituting for Part 3 of Schedule 1 the matter set out in Schedule 1 to this Order, and

(c) substituting for Part 4 of Schedule 2 the matter set out in Schedule 2 to this Order.

EXPLANATORY NOTE.

(This note is not part of the instrument and does not purport to be a legal interpretation.)

The Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (Allowances and Allocations) Order 2003 ( S.I. No. 59 of 2003 ) made provision for the payment of allowances to the Chairpersons of those sub-Committees in existence at the time the Order was made. This Order takes account of developments in the interim by making provision for the payment of allowances to the Chairpersons of all sub-Committees now in existence.

Section 8(5) of the Houses of the Oireachtas Commission Act 2003 provides for the payment of an allowance to each member of the Commission. The Order sets the allowance at a rate equivalent to that payable to Chairpersons of specified Oireachtas Committees.
