POSTAL AND TELECOMMUNICATIONS SERVICES ACT 1983 (ISSUE OF TELEVISION LICENCES) ORDER 2004.

I, DERMOT AHERN, Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 76(1) and (15) of the Postal and Telecommunications Service Act 1983 (No. 24 of 1983) and the Broadcasting (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 299 of 2002 ) (as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 307 of 2002 )) after consultation with the Postal Company, hereby order as follows:

1. This Order may be cited as the Postal and Telecommunications Services Act 1983 (Issue of Television Licences) Order 2004.

2. Subject to Article 3, the postal company is empowered to issue on behalf of the Minister and on payment of the appropriate fee licences for television sets in accordance with the Wireless Telegraphy Acts 1926 to 1988.

3. Article 2 does not apply to free licences for television sets under the scheme administered by the Minister for Social and Family Affairs known as Household Benefits Package or any scheme replacing that scheme administered by that Minister of the Government.

4. The Postal and Telecommunications Act 1983 (Wireless Telegraph (No. 1) Order 1983 ( S.I. No. 419 of 1983 ) is revoked.

This Order empowers An Post to issue on behalf of the Minister and on payment of the appropriate fee licences for television sets with the exception of free licences under the scheme administered by the Minister for Social and Family Affairs known as Household Benefits Package or any scheme administered by that Minister of Government.
